My lead attorney is Dow Patten esq and co-counsel is his partner Spencer Smith esq they also have a really sharp new attorney named Jerome but I don't know his last name off the top of my head. Their website is http://smithpatten.com/ with offices in San Fran and LA but handle cases all over. In selecting my attorney I chose to retain them because they are proven trial attorneys and made the USPIS attorneys (James Rickher supervised by Terrance McKeown) look like first year law students at hearing and various conferences with the Judge. They are VERY expensive but money well spent. When the agency attorneys only defense is to attack your credibility and not defend against the charges and/or respond to the damages your case is close to a slam dunk. Agency attorneys like Rickher and McKeown that go into private practice after leaving service are not the type you may want as representatives and ALL should be on the lookout for those type. Patten told me that most attorneys shy away from Federal Employee cases because they take so long to resolve compared with just going to Federal District court of which what we were going to do initially BUT when the EEO Judge issued her responses against the agency in every motion we are staying with the EEO process. Time is on my side now that the hearing is over (getting agency employees in before they retire) because the payout in my case grows substantially daily.

Word to the Wise. If you have passed the time limits within the EEOC guidelines you might as well pull your case out and proceed to federal court. EEOC has proven time after time that they are a management tool. The agency and the EEOC will delay the processing of you r complaint then use the time that has been spent processing it as part of their complaint against YOU - blaming you for it. LOL. Also, get this! I proved with the agency lied about reassigning me as a reasonable accommodation into a vacant position that I have 10 years specialized experience. The agency withheld that information and it did not come out until I filed in federal district court. Doesn't end here, the District Court ruled against me and did not even mention the position or the fact that the agency lied about it. Then I appealed the decision, not only did the appellate court rule against me and did not rule on the vacant position, but they allowed the agency to include another vacant position never mentioned before and gave a REAL bizarre reason of why I could not be reassigned into this new position.

As information becomes available I will update the board as to the status of my case and its processing. Given my only goal is to obtain the LARGEST payout achievable which is currently in excess of $2 million and increasing daily. A goal of seeing justice has long since gone. I have been unable to locate any other Federal Sector employee case with a larger payout thus making my case the largest non-class action case in history. With interest accumulation of back pay the loss to the USPS is as much as being paid an PCES/executive salary currently. Since their own medical dept determined me unfit to return then giving me an gun and badge again is understandably out of the question in their point of view of which supports front pay until mandatory Inspector retirement at age 57 which is 9 years. Megan Brennan and Potter along with the executives, managers and USPS Attorneys can go down in history as being the persons to be responsible for the LARGEST single person discrimination/retaliation case until a larger 1 comes along under the era of Trump even though this all really occurred under the Obama era. The USPS/USPIS has since the beginning of my case acknowledged in various motions and other documents that they are not providing any defense to the charges but instead are merely going through the lengthy process in an effort to get me to settle for pennies on the dollar as my costs increase steadily (medical/Attorney). I encourage ALL involved in an EEO or other similar process to FIGHT and thus prepare for that FIGHT. Start NOW if you have not already on your Prehearing Report's. I found the information and samples at http://www.eeo21.com/Fed_EEOC_hearing.html to be of GREAT help until I decided to obtain a trial/hearing attorney that did GREAT at my 3 day hearing in the local Federal courthouse. Seeing the look on the USPIS lead attorneys face at the end of my own full 8 hours of testimony of shock & awe (was priceless) when the Judge advised him that he risks being disbarred if he does not recuse himself from the case after being identified by me as being a percipient witness. The Judge directed him to obtain a letter from Megan Brennan to continue to represent the USPS in the case. He provided it and continued for the last 2 days of hearing just being a punching bag for myself and the Judge. I am certain the attorney's for the USPS up the chain have been lying to the persons they supposedly are tasked in representing.

Make sure your Prehearing Conference Report is up to date and should be an ongoing work in progress (exhibits/Attachments) of stuff not already in the EEO investigative report if you have any additional evidence not already in the EEO report. Cite page #s of the EEO Investigative Report in your Prehearing Conference Report. The Judge will want to address motions from both sides and try to see if both parties want to settle and set out an future settlement conference date with another Judge.

No, my case will not settle. There will be only OFO Appeal/Order and enforcement of said order order. With back pay and front pay (I requested reinstatement but agency medical says I am unfit). The agency offered $50k and my attorney fees of which are in excess of $150k to settle of which is less than 10% of my cases worth. I am fine with waiting it out since OPM Disability is more than covering my current lifestyle. My question to the board is anyone knows the answer is 1) once payment of back and front pay are received and the agency deducts retirement/taxes from said wages paid all in 1 year does OPM recalculate my annuity based on the HUGE payment that covers years of front pay and years of back pay? Any link to the OPM regs on this would help.

Last year OPM released an back pay (https://www.opm.gov/policy-data-oversight/...ack-pay-calculator/) calculator for Federal Agencies and employees to use in cases of discrimination that result in employees being owed money. I used it in my case and found it to be very helpful. You can save your work as I did on an ongoing basis so if you are approached with a settlement figure periodically you know how many pennies on the dollar the Agency is offering you related to what they actually owe you. You will have to manually track leave, TSP ect... benefits. Good luck and hope this helps.

Rivkah Ialso got that one from Gary Vaccarella oig came i found out that they sent checks to employees for compounded cream ,9,000.00 or more dollars a couple of times and the fools cashed them which created this problem and are now paying it back in installment ,and are trying to get people to give up dr for there wrong doing .oig inspector left card with me .but i did not sign any thing

Any letters employees receive from the DoL are between the DoL and the employee. The Agency is not authorized to have that letter unless authorized by you or the DoL. If the USPS OIG Agents are accompanied by an DoL employee (usually with a Special Agent) then you are assured the DoL has authorized disclosure of the contents of the letter. I have worked with DoL investigators and know this to be true as with ALL other Agencies (VA, SSA, IRS ect...). UNLESS the USPS obtained as Federal Search warrant of which you should have been shown. It appears to me that the USPS got a tip that they are being overbilled for medication(s) that they have been paying to the DoL. The Agencies hope is that they can get the monies back and thus will do whatever (even violating constitutionally protected rights) in order to obtain the money. ALWAYS remember, when Agents of the Federal Government come knocking on your door they are NOT there for your best interests.

Former USPS Inspector ,You are right my neighbor put up cameras in both directions 5 days before ,and when i came home that day they came to house 5 minutes after ,Now my main question isthe inspector waited a year for this letter to go through.There was 2 inspectors ,one spoke and claims he did not know about comp and asked on how long i am out ,what pecentage i am getting,shouldnt i be on permanant disabilty,when i went out etc,As i also stated for them i was put out by national reassement program,a grivence was filed,a second opinion dr sent to, ordered test never done before and upon this other dr doing test with dye and needle for pain ,put to much dye and and in pin after wet to my dr later complaining sent me to specialist orto that i had seen before formy same injury,now states i am on total disability due to exasorbating the problem ,i did not have before .so i told the oig agent to investigate the drs who did this ,also the my building labor dept for fillig in papers on grevience payout employees portion after i signed it and gave to my union rep and labor dept filled in after my signed with union reps knowledge until i asked for copies after also,fillig management portion .Called head of mailhandlers union stated errors ,stated go back to union rep who did it .i did and got run around from him.Sent 15,000 and change to unemployment and a smaller check that supervisor kept sending back to treasury dept and called them and told me .So notified union and supervisor sent it to me.A year afer ,and the 15,000 2 years later afer complaning to unemployment office.And i filed a labor board charge against union rep ,labor board stated union will handle this problem .6 month or more that union rep sold other employees out while union was now alerted about my case and removed this president from my building off slate .so i told oig to check out all of these bad fate acts by management and drs

Former USPS Inspector and Rivkah The letter i recieved was from OWCP Department Of Labor phone #202 693-0040 ,they claimed they sent a letter that i did not recieve about new authorization procedures on recieving this medical compounded cream .this letter states as a follow up and assistance in respect of potential fraud involving billing .DOL office of oig which is responsible ,waste and abuse in FECA programs .THEY CLAIMED they recieved complaints 1] That claimed recieved compounded medication ,they did not know about.2]claimants did not use compounded medication3]Claimants requested the pharmancy discontinue sending.And explains ,for example some medications can cost up to 10,000.And give a website and tel# to fill out form etc...
