There is no way they are going to hire you back for modified duty. I would talk to the union to see what they say but I can’t even imaGine...

The letter states it's a modified duty offer , once I've been reinstated as a postal employee. I trust that you're saying it probably a bluff. I sure hope they're not going to cancel my DR. I went to a referee back in June 2017, and just received the letter. Letter states referee doc says I can work with modified duty. I was a letter carrier, job offer is working inside P.O. I assume as you say, that's it's probably just to get me off of workers comp. Thank you for your help and guidance.

It’s likely a bluff. If it’s within your restrictions, you will have to accept it or take DR. I seen this many times. In order to rehire you, you would have to pass physical for the job.

Hello, I was approved for disability retirement from the USPS approx 6 months ago, but opted to continue with workers comp because it's more money. I just received a job offer from the USPS with a start date. What is going on, they can't force me to go back to work, can they? Is this a trick to get me off works comp? Please help.

cleark d - If your reconsideration appeal was not timely and then you filed an ECAB appeal about the untimely reconsideration appeal and ECAB decision said your reconsideration appeal was untimely, then that's the final word.

If the union rep. helped you with your reconsideration appeal and it was the union rep's fault for having you file it late, then you could file a complaint with NLRB about the union rep., but it sounds from your messages, that the reconsideration was untimely.

MSPB is used if you have been terminated from your job, if you have recovered from your work injury and agency won't let you back, retirement appeals and other items. I don't know if you have been fired from your job and/or if you've recovered from work injury and agency won't let you back.

Thanks Neice.I did ECAB appel in time one of reconsideration before ECAB was not on time .This is ECAB desicion why it mix up with reconsideration ?which was past?can i go to MSPB OR NLRB?Thanks.

cleark d - I didn't say you could go to court. You can't. If ECAB didn't give you the option to appeal their decision, then you are out of luck if your appeal was not timely filed. If you didn't file your appeal timely and you didn't have a valid reason for filing late, then it's done. There is no court. The highest court dealing with owcp is the ECAB.

cleark d - It's odd no one at the practice knows where your doctor moved to. If you tell the office mgr that you just need the old dr to write you a referral to a different doctor at that practice, maybe they'll let you know where he went. You also can try calling the state regulatory dept and asking them where your doctor went. If you can't find him, maybe he retired, you will have to write to owcp requesting a new doctor like Snowed said.

ECAB is the final decision, but sometimes ECAB gives you the option to file an appeal and if they do, it will be in the decision near the bottom of the decision. If you were late in filing your ECAB appeal, then you are more than likely out of luck. There will be no next step.

You might be ok with the same practice but different doctor but generally when you switch doctors you either need a referral from your old doctor or request a new doctor and explain why to OWCP in writing.
