Try to take a witness in. Some doctors will allow one. If anything they can also witness to how long you were in there. A 5 minute appointment can’t be discredited easier than several hours.

SNOWED, You said take a witness with me to the SECOP appointment? What if they say I can't have no one in the room with me? I remember one time before a SECOP
had a sign up that read nobody but the patient can be in the room.. Another question…They only gave me 10 days after I received the letter to see the SECOP. Thats
not enough time for me to gather XRAY'S or MRI'S or if I was going to ask my Doctor to come to the appointment…Shouldn't I have been allowed at least 30 days?

Also Im sorry if I am asking you repeated questions. My memory is not that great anymore. Since you have a serious back pay issue you should be climbing the chain of command seeking help. I would at this point go right to the top and email the US Secretary of Labor.

Yes you can upload a letter requesting a SOAF and questions posed to the SECOP. I would do it now even if you may not receive it in time. Take a witness with you to the appointment and audio record it if you can.

Snowed, No back pay yet .. I contacted my Senators Office and they wrote them on Nov 13th.But they have not responded yet.When I called my CE she said ,she was done with it and she passed it on to the Senior Claims Examiner.(Her Boss).I guess she has to make sure she came up with the right figures. But I dont understand why it should take 16 months from the ECAB decission to pay me. But here's the killer. The job offer that they offered me back in 2014 and I won the ECAB Appeal on, is the exact same Job offer they are offering me now.The job offer is not suitable. My restrictions say I'm totally disabled.As I mentioned in my last post they are now sending me to a second opinion Dr. They said they determined a second opinion is necessary in my case to address issues related to my claim. I don't know what issues they are talking about..The letter was addressed Nov 30th I recieved it on Dec 9th. the appointment with the second opinion is Dec 19th .. I dont have enough time to gather XRAYS or anything. They could have atleast gave me 30days. Also I never heard anything back from them from the Nov 6th Job offer. Can I ask for the Statement of Accepted Facts that they are giving the Second Opinion.? I probably dont have enough time since my appointment is next week...Thanks Snowed for your help...

No back pay yet? Have you written to the District Director for help? retirement in lieu of job offer? You can’t refuse a job offer if it is suitable if you want to continue receiving wage loss. If you choose to retire voluntarily and not take the suitable job offer, you could even lose any potential schedule award.

Also a SECOP doctor you cannot participate in the selection but you can for the referee physician. I would check over at the OWCP classroom site for particulars on the selection process.

You would likely have an easier time filing a new workers compensation claim. File a CA-1 if you can pinpoint one day that aggravated your condition. File a CA-2 for occupational disease for aggravation of pre existing DDD if you can not pinpoint one day.

As a note you might want to keep the neck separate from low back even filing 2 claims if needed to cover each. This could benefit you in the event of filing for a schedule award in the future.

A few years ago i had an accepted owcp claim for my neck. The original injury had since healed, but owcp also accepted Degenerative disk disease on my claim. My case was later closed for medical and compensation. I had other insurance and back to work, so i was glad that happened. But i missed much work later due to a different job position and suffered from headaches and neck spasms causing me to miss much work later through the next few years. They were episodic so i never opened up an aggravation claim, just dealt with it, with medications. My lower back began to deteriorate also due to the DDD. Long story short, I was recently terminated from my job, even though I explained my situation and with documentation, to no avail. But since I am no longer employed, ( union going to fight it ) does that mean I can open at least for medical treatment for the DDD ? The acceptance of DDD did not specify just cervical but DDD in general.

Hello , I was on OWCP for several years. In 2014 I was terminated. So 07/2016 I won my ECAB appeal. As of today I have not received my back pay. I was put back on the rolls though. But I received a job offfer in November. Same job offer that I received in 2014 (And Won my ECAB Appeal for) Well when they sent the job offer they also sent me a letter asking if I wanted to retire inlu of the job offer. I sent it back and said I would like to retire but not until they close the part of my case with ECAB.(paying me the back money I lost) Well I just received a letter to see a second opinion. My question is can I find out why I’m being sent to a second opinion. And was the selection done properly?

HI Sonal You need to fight it- WHO was your healthcare provider- Mine was Blue Cross and Blue Shield and they told me that if I was denied to fax them the letter of denial and they will cover it- YOU can ask for an appeal

Cleark d Sorry to hear you were injured- SHOW your insurance provider that your OWCP has been denied they must pick it up then. YOU must show the written proof- SEND them a fax with the proof.

Hi,I had injury at work.Owcp denied my case so i turn to my health insurance for treatment ,.untill november i get physical therapy with my insurance.When i started my treatment with my insurance i told them that my injury is work related and owcp denied my claim.Now after 5 months my insurance denied all payments with reason that my injury is work related .Now my physical therapy stops as my insurance not paying .I received all bills from everywhere that i am responsible for that.
My question is that what i can do ?in this condition.? I am working less hours i have not enough money for my bills and Injury happened at work and i had insurance .If both denied to pay for treatment ,what are my options to get treatment ? I have right to get treatment as a injured employee and ,as a patient and as a civilian .Agency and insurance both or either not taking there responsibility what are my options ?Please guide me.Thanks.
