Snowed Thanks. I know you have recommended contacting the SOL. I have only done it once before and it definitely rattled some cages.

Clark d. I'm aware of the Postal Employees Network (pen) and Federal Soup. Not sure if there are others. There is also a site called the OWCP classroom with lots of information and a blog.

Snowed. I sent a pm on fed soup. Any advice would be appreciated. I am still waiting for a legal consult. In the meantime, I sent a letter to the SOL and ccd it to the district director. I sent the dd letter by pm which was never scanned delivered so I don't know if it was received. That seems to be a pattern right now with priority. I sent the SOL express.

It is SOcial Security that reduced your wife's and your SSD benefits before full retirement age based on OWCP payment. After full retirement age OWCP will reduce its payment but you and your wife should get your full Social security payment...they take forever to fix this stuff...good luck.

Sorry Wrong about VR...I believe this wAs changed recently.
"(4) A claimant who enters a vocational rehabilitation program during the course of a schedule award is entitled to receive compensation at the rate for TTD. This entitlement is satisfied by schedule award payments as well as those for TTD. It is therefore not necessary to interrupt a schedule award for payment of TTD unless the claimant is also receiving an annuity from OPM. In this case, the payments must be converted to TTD and an election must be obtained, as vocational rehabilitation services cannot be provided to an individual in receipt of such an annuity."

"(5) If payment for TTD is interrupted to pay a schedule award, such TTD payments must be resumed at the end of the schedule if the claimant has not been reemployed or rated for LWEC at the time the award ends (see Goldie Washington, 31 ECAB 239 (1979)). Therefore, it is extremely important to establish the claimant's earning capacity before the award ends. It may also be necessary to obtain an election if the claimant is also receiving an annuity from OPM."

I don't think you are correct. Often OWCP will hold off paying the Schedule Award while a person is on wage loss but they can replace the wage loss with the SA. Yes the claims examiner is encouraged to calculate a LWEC if possible but often there is not enough info in the record to do so since VR can not be approved during a SA. If the claimant was receiving total disability wage loss at the time the SA commences then the claim examiner is obligated to return the claimant to the periodic roll if no LWEC is authorized.
