Agreed -- a large percentage, if not all legal fees should be awarded to the defendant as damages, if it is found that the patent enforcement was frivelous or disingenuous in some way. This would go a long way towards preventing problems, imho.

Put simply there must be appropriate penalties for mistaken
claims of originality on patents, and mistaken claims of
this-cover-that for patents.
