The most important quote in the whole article: "No matter which service you try, you'll almost always pay more for an album's worth of music than you would by buying a CD in the store."

I've tried emusic three times, twice with an actual subscription and once (recently) with a trial. Everything is lovely...except the music. The mp3s sound absolutely awful. Even on cheap speakers you can hear how poorly encoded they are..on headphones or a decent setup they are completely unlistenable. Once they get around that, though, I'm sure they'll have my money again.
Epitonic is wonderful.

Another vote for emusic! I thought for sure I would have ditched my subscription by now, but it's a good service. And I just got the new Cat Power album on the release date. How cool is that?

and then there's epitonic.com. Absolutely free; thousands of (almost all indie label) artists, represented of their own free will. Download mp3s or streams - anywhere from one to full albums, depending on the artist. Excellent hyperlinks from artists pages to make discovery of new artists within your musical interest highly likely.
The last several cds I have bought have been of artists I first discovered on epitonic.

I too have an emusic.com subscription that I am happy with.
128kb mp3 files, you own them even if you decide to not renew your subscription, flat rate pricing for all-you-can-eat downloading.
Frank Black, Camper Van Beethoven, Louis Armstrong, George Carlin, They Might Be Giants,... It's not exactly chock full of "mainstream" acts, but there is plenty of good stuff there. Plus, with flat rate, I get to explore things I wouldn't otherwise download with a pay-as-you-go scheme, and discover bands like Firewater and Alpha Blonde.

David Pogue completely missed emusic.com. Fairly decent collection of music, it's all MP3s, it's not too expensive -- I've been insanely happy with my membership. They have Mojo Nixon, Midival Punditz, Noam Chomsky, Tom Waits, Creedence Clearwater Revival, John Coltrane, some Pere Ubu... it's a non-crappy selection. They seem to have the usual big label participation, but they aggressively sign indie labels to go with.
