Quit over pants?? Come to some of our offices... The lunch relief doesn't even change into a uniform shirt or put an apron on to work the window! You have to file if they're hassling you.
I admit I buy my own pants (okay, some are shorts & capris), but I troll the clearance racks (a very nifty $5 navy skirt @ Walmart last week) so I can wear COMFORTABLE bottoms. If I'm at the boob-high window wearing knee-length shorts & I'm next to someone in jeans, just try to tell me I'm not in uniform.

fl clerk -- you represented someone at EEO? Do you know that in addition to things such as race, religion, and gender you can file an EEO claim on the basis of retaliation?

I wasn't the one with the complaint. I was just the support person. And race, religion, and gender would not qualify. Oh and hostile work environment doesn't even begin to explain how bad it is to work there.

fl clerk -- you don't have to be the one filing the complaint. You said you "represented." That's good enough for filing for retaliation. From the EEOC website:
"Discriminatory practices under these laws also include:
harassment on the basis of race, color, religion, sex, national origin, disability, or age; retaliation against an individual for filing a charge of discrimination, participating in an investigation, or opposing discriminatory practices"

I have a question. My new time to report to work is 6:45 and leave at 9:00. At this time there is still PO BOX work to do and of course the PM is doing that. Then I come back at 10:50 and relieve the window for a one hour lunch, close out and go home. The PM is saying if they bring me back within a certain amount of time they dont have to keep me for two hours. Does anyone know if the PM can do po box work or work me for less than 2 hours and where is the rule if so?

Is anyone here from the offices in the albany ny district where po is trying to consolidate? Example: Schenectady po, niskayuna branch, glenville branch, or any of the albany stations? Just wondering what po is telling clerks and how much time will take place before this happens?

me... /m12111 PLEASE get to a Union officer, or Steward. Past Practice was you doing box mail. Your PM is correctly giving you AT LEAST two hours the first block...but failing to do so on the second. MULTIPLE violations here. The PM will get away with killing you job here IF you do not act NOW! Read posts on these forums by WNYClerk. The dude knows about all these, as one who is desperately trying to save his job and hours. DO not sit still now. You are up to bat and the PM just started throwing strikes.

if your lunch is more than 2 hours long, you are guaranteed at least 2 hours of work upon returning. you are getting an hour and a half lunch so there is no automatic 2 hours once you are back on the clock.
also keep in mind that you cannot work beyond 12 consecutive clock hours. simply stated if you start at 6 am you cannot work beyond 6 pm. you could start at 6, work til 8, come back at 4 and go home at 6, and there is no violation.

Kitty, does tht mean that the days that they send me home at 12 (on Saturdays) and have me come back for an hour in the afternoon to close the office....then they would owe me 2 hours??? I questioned this before and was told the gap between 12 and 4 was my lunch, then I work an hour, the 2 hour guarantee does not apply due to me having the 2 hours prior to lunch. If I am reading what you are saying correctly, then I am owed some big bucks.

A split shift is when you report back to work within 2 hours. You have no guarentee for the second period.
If it is longer than 2 hours when you report the second time you have a guarentee of 2 hours for the second period. If you have not been getting this you need to discuss this with your PM/Sup, and ask for back pay.

Don't let them say it doesn't apply to you! It applies to any size office! When a part-time flexible employee is notified prior to clocking out that he or she should return within 2 hours, it is considered a split shift and no new guarantee applies. However, if prior to clocking out, the part-time flexible employee is told to return after 2 hours, that employee (in any size office) must be given a minimum of 2 hours work.

If the clerks have always done the PO Box Mail, now the PM is sending you home and doing it themselves, this is shifting clerk craft work to management and violates our contract. Let your steward know this is happening. They will want to know the differnce between how much time the PM used to spend doing clerk work, and how much now with the changes. Don't expect it to stop however. I think the best we can hope for is someday they will settle a national level greivamce on this and we'll get some part of a settlement. Same thing with my office. Clerks used to do all clerk work, now we are sent home after 2 hours even though first class is not even in yet. Most days PM in barely getting it in by the up time. So, if the volume ever rebounds they will eventually either have to start increasing clerk hours again, or watch the PM have a nervous breakdown.

The only thing I know for consolodation in Albany district is combining Binghamton, Utica, and Watertown into Syracuse. They are supossed to be studying it, but it has already happened since our dispatched Mail is now going to SYR instead of BGM.
