The authors mention that "although the hard max ratio penalty in (5) appears to be ad hoc, this objective is not entirely unprincipled." They go on to say that "in the special case where the origin function happens to be close to the Bayes-optimal predictor, minimizing (5) will result in near optimal generalization performance in the base hypothesis class".
