You can download your own CA-17 of the net and get your doctor to write in restrictions. Your shop steward should be able to get you a CA-17 and he/she should file a grievance about only giving you three days to get documentation. What if your doctor was out of town on vacation? Once you violate your restrictions you open yourself up to fraud charges.

Sorry to hear you are going through this. All the advice you have been given is great. One more thing DO NOT GO AGAINST YOUR WORK RESTRICTIONS. If you do then OWCP can say that you are able to do the job. If your sup. threatens to write you up let them. They know it won't fly so nothing will come of it. They are just trying to scare you and once they realize you are not going to roll over for them they will back off.

you can even call osha and report this... unsafe practice.. management trying to get me to work off clock.. trying to get family memebers to work... work against your med restrictions... you do all this and when stup tries to do something else to you... if you have this in his letter.. i would file eeo... did he do this to anyone else??? discrimination....

Darkrose.. did you request stward to go in with you? stup gave you this in writing??? awesome.... write stup a letter requesting extention of time to get info from dr... 3 days is unreasonable... i would file grievance... he wants you to work outside your med restrictions? don't do it.. file another grievance.... reguiring you to work off clock... file another grievance... trying to get a family member to work without pay.. not a postal employee... i'm sure can be another grievance... talk to union on filing hostile work environment greivance... 1767, i think that is the # unsafe practice (trying to get you to work outside your med restrictions... i would take a few days off for stress and go see my dr and relay what is happening... get him/her to write note stating you are out due to stress from the work environment... have dr write issues down to verify later.. i feel eeo coming up.... start your papertrail as this stup is not going to stop.... if you want have your steward go with you and report these actions to your pm/another stup and request this harassment to stop as it is starting to effect your health further.... you have to start fighting back.... better yet "put this in writing to your PM/all stupervisors" make copies for your eeo... start a diary... you will probably need it....

Just an update, had an unannounced pre-d today, Sup had given a direct order which I tried to explain to him was something that I needed to discuss with my Dr. since I felt complying would violate my restrictions, after the Pre-D, the supervisor gave me a letter of instruction Thursday afternoon requiring me to produce medical documentation in regards to my being able to perform the task (which is not included in my accepted job offer) he gave me a deadline of next Tuesday (which would be less then 3 business days) but still won't give me a CA-17 or a proposed modified job offer to take to my Dr. He also included instructions that would require me to violate my restrictions by bringing an item home from work (no lifting) and perform part of the task off the clock at home, with the assistance of a family member, which I feel would 1. Require me to work off of the clock and 2. Constitute a direct order to my family, who do not work for the Post Office, which he has no authority to do

I have just started PT for my shoulder, even though I gave my therapist the script from my dr. he also wants to see the mri report, I don't have a problem giving him this info, but what I don't understand if he has the script from my doctor why the mri report? I would think that the script is all that he needs.

john king thanks for the reply back i am just three weeks out of surgery still rehabing. if you get any more info please let me know im new to this do not know what to expect next if you have any advice youd like to share please do... have a good one griff

I am only 52 with 23 yrs. of service. We have no mail in manual letters. They are getting rid of some bids. I will be affected. Disability or Early Out? THANKS

You probably need a lawyer who does federal workers compensation to help you. When you have to fight a referee you have an uphill battle.

I am going to look into just which pump I had, but the letter I got from the lawyer said any pain pump. I don't know if it is worth pursuing but if cartilage in your shoulder was destroyed following having a pain pump inserted into your should you may have a case. How much it is worth I don't know yet. I did not know about this until I got the letter from the lawyer. This guy could just be spreading a net to see what he can get and may be a bottom feeder. I don't know. My shoulder is not right even though I have ROM and the shoulder is pretty strong. I still cannot do a pushup because the shoulder gives out. This is 5 years after the surgery. It is worse than it was then.

Darkrose... also do what your Claims Examiner tells you to do before, management... they are the ones that pay you... if you had a conversation with your CE, you can request a copy of you comp file and this phone conversation should be in it...

Darkrose 10747, Get the union involved. Steward or the local should be available. This starts the paper trail. They probably are just trying to frustrate or infuriate you, jerks.
1st you would benefit if you carry a little note pad of some sort & record the stupidvisors unreasonable demands along with your responses.
2nd you should never work outside restrictions...they can't order you to do that,safety hazzr'd, not without reprisial.
3rd let them change the job assignment...you might just remind them of task outside your restrictions. They get paid big bucks to figure that out. Smile & watch them get bent out of shape, don't let them heap the coals upon you, you don't need the extra aggravation.

Darkrose.. i have alot of med restrictions... like no casing, no culling the mail... there are times when management ask me to do these things still.. i just inform them that i would love to do case mail.. but it is against my med restrictions and can't do it.... the union has told me that if management forces me to do this... (case mail).. to case and then file a grievance... i have read up on this and disagree.... i tell management that it is unsafe for me to go against my med restrictions and if they still want me to do this.. to put it in writing... i still would not case mail but i would file a greivance and now would have it in writing... to throw fear into management or to throw them out of whack.. i find is to know more than them.. to know the rules/regs.. this keeps my stress level down.. if management gives you a direct order... you can say you feel it is unsafe for you to do it as it may/will go against your med restrictions... management can't force you then...

To John King just wondering what shoulder surgery you had and which pump you had also how did you you hurt your shoulder, i just had shoulder surgery from a fall while delivering mail, they put a pump in my shoulder after surgery, something just doesnt feel right to me thanx for any reply
