UNITED STATES SUES NINE IN NATIONWIDE CRACKDOWN ON TAX-REFUND SCAM
WASHINGTON, D.C. - The Justice Department announced today that, in a nationwide crackdown against a tax-fraud scheme promoted by Peter Eric Hendrickson of Commerce Township, Mich., it has brought suit against nine people this week. According to the government complaints, filed in seven lawsuits across the country, the nine peopleincluding Hendrickson and his wife Doreen M. Hendricksonhave received a total of nearly $150,000 in erroneous tax refunds by submitting false forms with their federal tax returns to replace W-2 and 1099 forms that correctly reported their income.
In seven suits filed in U.S. district courts in California, Nevada, Michigan, Alabama, Florida and Kansas, the Justice Department seeks to recover the erroneous refunds. In addition, the suit against Hendrickson, filed in the Eastern District of Michigan, asks the court to enjoin him from filing false tax forms and returns. A violation of the injunction would be punishable as contempt of court.
According to the complaint, Hendrickson claims that only government workers are subject to income taxes. Hendrickson tells people to not submit their W-2 and 1099 forms with their tax returns, and in their place submit substitute or corrected W-2 and 1099 forms that they create on which they change their reported income to zero. Under the scheme, people then submit the falsified forms with a tax return falsely reporting no income and request a refund of all taxes withheld from wages. Federal law provides serious penalties for filing false tax forms, said Eileen J. O Connor, Assistant Attorney General for the Justice Department s Tax Division. People who engage in tax fraud schemes can expect to pay back taxes, plus interest and penalties, and may face criminal prosecution for evading taxes.
The suit against Hendrickson alleges that he was convicted in 1992 on federal criminal charges for failing to file a federal income tax return and for a conspiracy involving a firebomb placed in a bin at a U.S. Post Office in Royal Oak, Mich. on April 16, 1990, the last day on which tax returns could be postmarked that year. Hendrickson testified at a co-conspirator s trial that he wrapped a tea bag around the bomb s tubing as a reference to the Boston Tea Party tax protest.
The seven people sued in addition to the Hendricksons are Sharon K. Artman of Largo, Fla.; Michael J. Dowling of San Diego; Joy M. Ferguson of Henderson, Nev.; Melvin L. Gerstenkorn of Topeka, Kan.; Larry B. Golson and Debra G. Golson of Montgomery, Ala.; and James A. Spitzer of Winter Park, Fla. Actually, to be totally honest, that thought had never occurred to me. If the "tax patriots" believe the courts are corrupt, why oh why would Dale and Anonymous 2 cite them ad nasauem? I swear I can picture Anonymous 2 (although I am partial to my hubbies nick for the idiot - "Coward2")walking around muttering "Yick Wo" much the same as Dustin Hoffman and his "Wopner's on" line in the movie "Rain Man".

  You are absolutely correct regarding Dale Eastman citing cases out of context. I have suggested to Dale and others on the Trial-log that their positions are actually Constitutionally off point, and have NO chance of winning in any U.S. Court. My statements have fallen on deft ears.

The so-called patriots movement are under the delusion that the courts are supposed to argue their off point issues for them; at the same time the patriots believe ALL courts are corrupt — through — and through. These dichotomies are false from both ends of the legal spectrum. The courts are not there to put up a defense for the defendant, anymore than prosecute for the prosecution. And if the patriots really belief that the courts are corrupt they have failed to prove it, via appeals, for the past 35 plus years.

So getting back to Patriot’s untenable position: Why should any self-respecting, true believing, patriot believe anything that the courts have to say, even those cases Dale cites for his authority? The whole premise of David Jahn’s site is prejudicial: Which is, everything is wrong with the justice system and nothing is right with the government. If that statement was truly the case the American people have Constitutional means to correct it. But first you have to identify the real legal issues before sticking your foot into your mouth. Which I have suggested the patriots have been doing for over 35 years.

Their solution was to shut me up, along with a few others: They (Dale) had David Jahn BAN me from his site – I guess any opposition to their views or truth hurts their sensitive ears. Since the banning David’s site appears to have slowed down to a trickle of the same old rhetoric and same old gibberish.

The essential claim of sophistry is that the actual logical validity of an argument is irrelevant (if not non-existent); it is only the ruling of the audience which ultimately determines whether a conclusion is considered "true" or not.

While Dale likes to pretend that he is "citing" court cases, he's actually taking the cases out of context and using demented definitions of words to appeal to the prejudices and emotions of wannabe tax protestors. He can garner favorable treatment for his side of the argument and cause a factually false position to be ruled true. That you could actually consider the possibility that the income tax is a vast government conspiracy, kept alive by thousands of people without one ever "cracking" - is proof that those of the tax protesting mind set believe only what they want to believe. They arrange the facts to suit their pre-formed belief. Eastman is a prime example of this.

I read his site and it is mostly supreme court cases and what the court says. It that what you mean by softistry?

I'm back. Things kept me away for a few. I ignore it and this is what happens? JS, I wouldn't read anything written by Dale Eastman, unless I needed to fall asleep real fast. He's the undisputed king of sophistry.
