i am under the impression that if a ptf works up to 6 hours 7 mins they are not required to take a lunch? does anyone know if this is true and the resource I could site it from?

Newman, you may not be involuntarily removed from a hold-down unless there is unsufficient work for an unassigned regular. Of course, the UAR has more seniority than you, but that does not the service the right to violate your Article 41 opting rights

Does anyone know if and where it is stated that PTFs must have a non-service day every fourteen days?

It was and is a full route, but because of the MIRAP process they were thinking of making it an AUX, but after talking to the MIRAP Union guy he said they found the route to be undertime and thus making it an aux, hence I lose my opt on it. Next week after adjestments it's back to a full route with someone else on the opt. Sucks for me I guess..........

I am a PTF City Carrier and was recently holding down a route while the regular was supervising (204B). This has been going for about a month.

Two weeks ago I had a medical situation and was put off work by my doctor (notes faxed into P.O.). During that time an unassigned regular took over the route. I understand that as a PTF I can be bumped off an assignment by an unassigned regular, I'm fine with that. My question is, I have another Dr. appt. tomorrow (Monday) and I think he may put me off work for another week or two. Thing is, they have me scheduled to come in at 10am every day this week. So if I'm out on medical leave, do I get 8 hours of sick leave for each day? If I WAS working, starting @ 10 I wouldn't likely work the full 8, so do I get 8 hours of sick leave?

Karl C /m4386 What about the Saturday BEFORE your week of A/L? Did you work? Because if you did, then they can just make another day of the week that you're on A/L as your N/S day. And normally, while working six days a week, Friday would be your overtime day. But since you're on A/L, your sixth day can't be paid with A/L if it will put you over 40 hours for the week. And since management knew that they would schedule you to work Monday thru Friday after your week of A/L, then they were smart making your Saturday before returning to work as your N/S. Just like when I was a PTF, whenever I took a week of A/L, I only used 32 hours of A/L, since our week of A/L starts on a Monday and the work week ends on a Friday, for pay purposes. And since I worked the Saturday prior to my week of A/L, that's how PTFs only end up using 32 hours of A/L, instead of 40 hours. And still get a whole week off.

Leave for part-time flexible employees is governed by ELM Section 512.521 which states:
512.522(a) A part-time flexible employee who has been credited with 40 hours or more of paid service (work, leave, or a combination of work and leave), in a service week is not granted paid annual or sick leave during the remainder of the service week. Absences in such cases are treated as non-duty time, not chargeable to paid leave of any kind. Supervisors should avoid granting leave resulting in the requirement for overtime pay.

512.522(b) Part-time flexible employees who request leave on days that they are scheduled to work, except legal holidays, may be granted leave provided they can be spared. Leave charged cannot exceed 8 hours on any one day. The installation head may also consider a request for annual leave on any day a part-time flexible is not scheduled to work. The 40 hours paid service in a service week specified in 512.523a may not be exceeded.

Does anyone know where there is any language in the ELM or the National Contract that gives management the right to make Saturday of a PTF's vacation a non-scheduled day during their vacation so they can make them work the Monday thru Friday after without overtime payment? Is vacation 40 hour blocks or 32 hour blocks?

nihil95 /m4378--Thanks for the post. I hope the B-team does get the point in this matter and sees that management was intentionally screwing around with the scheduling and therefore permits the requested remedy. I will post when I know.

   I don't think that your situation qualifies as an emergency...

   On the other hand, you aren't bothered by them violating the Contract by having RCA's deliver city routes, so i don't understand why you would be bothered by them violating the Contract by having a TRC do it instead...

   This is the slippery slope you end up on when you let Management get away with contract violations.

Ptf are able to work at other PO's within their district. Do that why the stupidvisors refuse to post a schedule. If TE worked at your office any of non-sheduled days ...file, file , file....get their free money and they will learn. Voiceofshit why don't you and crawl back into your snake-pit A-hole? Stupid FXXXXXXXer! There is no wonder why the PO sucks, and sucks hard like you do!

Thanks for the answer, that's what we thought too. We're being told this guy is going to be a "utility" guy. He's going to pick up auxiliary help for rural carriers, help do clerk work, and if needed, carry city relays too.
Mgnt says they can do this because it's a emergency situation and he'll likely be gone after Christmas.
The RCA's say they don't need him. We are short a clerk, and our office is small. I'm the only PTF and on a hold down "until further notice". If we want a day off, an RCA carries a route for us.
This really doesn't bother us as we're used to it and understand that they are just trying to make a living too. We're just not to keen on the idea of a TRC coming in a taking hours we would rather give to RCA's who know the routes.

ptf12 /m4380 -- you can't opt on auxiliary routes, so how did another PTF "zoom in"? And if you could, why would it not continue to be yours?

CAN ANY UNION OFFICIAL answer this question for me? I am on a long term opt since last Dec. My office lost our AUX route last mirap session in May. Well here we are 6 months later and they are doing another one. Rumor had it that management wanted to make my route the next aux route, which if they did I completely understand that I loss my opt. Well, in their infinate wisdom, apparently they didn't want to turn my route into an aux, or they'd lose a vehicle and mangement didn't want that. But in the meantime the mirap team deamed my route as an aux and (6 monthes prior it wasn't) they added a collection route to it. BUT during the brief time it was an aux, another ptf (with inside info) zoomed in and opted on it. Can they do that? It was evaluated as a full route last april, can they (mirap team) in the course of an evaulation deem a route an aux thus changing the status right then and there? Just curious if anyone know anything out there. I'm going to call my union rep tomorrow to see if he knows anything

   A TRC is the rural equivalent of a city TE. They should not be doing any city carrier work, as that would be crossing crafts.
