Landmark ruling for child sex abuse vicitms

Adult survivors of child abuse can now sue their attackers for civil damages, even decades after it happened.

With this watershed judgment, the Supreme Court of Appeal has opened the doors for civil recourse for thousands of abuse survivors who had often been left without help, because previously, victims could not lay a charge for rape and child abuse if the crime happened more than 20 years earlier.

The application was brought by a Esme van Zijl, who was raped, sodomised and indecently assaulted by a relative more than 40 years ago.

In their judgment, the court has also recognised a well-known psychological phenomenon that adult survivors of child abuse sometimes take a long time to recognise that what they had suffered was not their fault.

'Abused children have a right of recourse against their abusers'The judgment, written by Justice of Appeal Jonathan Heher, brought South Africa on a par with the US, Australia, New Zealand and Canada in the recognition of the rights of adult survivors of child abuse.

Van Zijl, 51, wants to sue her relative, who is a retired businessman, so that she can pay for the extensive therapy she needs to overcome the serial rape and abuse she had allegedly suffered at his hands.

She claims that she was sexually abused, raped and sodomised by him between 1958 and 1965, starting when she was six years old.

In terms of the law, as it was before Monday's judgment, she should either have sued him within three years of the date that he first abused her, or in 1973, the year she turned 21. But Van Zijl became aware of the effect of abuse on her psyche, personality and ability to function as a person only in 1997.

"Abused children have a right of recourse against their abusers," Judge Heher said in his judgment.

'The law no longer conspires with perpetrators of child abuse to silence victims'"Until the 1980s, the right was seldom invoked and, in South Africa, probably not at all. Major reasons were cultural or societal taboos (many abusers are close family members), and ignorance.

"Since then, the boundaries of understanding of the psyche of survivors of child abuse have been pushed back by expert studies of the problem, and the true nature and extent of the effects of such abuse has been become better appreciated.

"As survivors have become more informed about their condition and rights, and have received support from public interest groups, there has been an upsurge in claims, many by adults who initiated proceedings years after the actual incidents.

"This, in turn, has given rise to a spate of cases, particularly in the United States, in which defendants have invoked limitations statutes," Judge Heher said.

"This is the first case of the kind in South Africa of which I am aware," he added.

He said society as a whole was, during the period prior to 1980, more conservative in matters involving sexual mores than it is now, and considerably less willing to confront sexual matters.

"Approaching the (case) as if it were akin to discovering cracks in a house foundation, does not demonstrate any great... sensitivity to the psychological and emotional problems suffered by a woman."

Michelle O'Sullivan, the director of the Woman's Legal Centre, which handled Van Zijl's case, said the case would affect how future cases of child sexual abuse would be handled by the courts.

"Other survivors will now be able to bring claims knowing that the law has developed an appreciation of the psychological obstacles that prevent adult survivors from bringing claims.

"The law no longer conspires with perpetrators of child abuse to silence victims by preventing survivors from claiming damages later in life, as it is now recognised that it is the abuse itself that often prevents a survivor from taking action. Abusers will not be able to rely on the Prescription Act to avoid such claims," she said.

I want to thank Matt Clarke for taking my call this morning and to
share the
advice received from him.

As you all know, Canada has the distinction of having a tougher duty to
report law when it comes to child abuse and I have also recently
learned
there is no statute of limitations for prosecuting child sexual abuse
in
Canada no matter when it occurred.

That being the case, we still live in the real world of budget and
resource
limitations and according to Matt, if we really really want the
Minister of
Children and Family Development to take investigative action, we need
to be
able to furnish a list of specific names of British Columbia children
under
the age of 18 who are most vulnerable to being taken to India to see
Sathya
Sai Baba.

Some of them may already have been abused and of course, that would be
most
helpful to know as well.

After several discussions, I finally realized there is one person in
particular who would be most likely to be able to produce such a
list...namely Susan
Susan was a Bal Vikas teacher at the Vancouver Center for 25 years up
until
2001 and could strongly be presumed to have such a list. She would also
most
likely be able to tell or find out who are the current Bal Vikas
teachers at
the center.

Being in a position of care for children, emergency situations alone
would
dictate that she would have access to the names of all the children at
the
center and their parents address, telephone numbers etc...and possibly
even
a complete list of all the devotee members of the center.

Now the question is, what is the best approach to Susan?

It is my understanding that her current marriage partner may not
encourage
her to become involved in helping us, yet he and Susan did attend along
with
several other former devotees known to Mr. Danis a screening of the
"Secret
Swami" before it actually aired in Canada.

Perhaps a direct request from Matt might do the trick.

In any event, I am asking James to make Susan's phone number and
address
available to Matt and myself (I lost it when my computer database
crashed)
and I would appreciate hearing from any of you with your suggestions.

I do not want this opportunity to slip away and I agree with Matt that
we
need to furnish specific names to insure that our request to Minister
Hagen
and the other Ministers will not be ignored or side tracked.

Another possibility would involve the names, particularly of Sikh
children
under the age of 18 in the Delta Surrey areas of Greater Vancouver.
According to Tony, many of them already claim that SSB is a pedophile.
That
means their parents know and that their parents need to report what
they
know.

My rough draft to Minister Hagen is almost ready to send, but after
talking
to Matt this morning I will wait sending it until I hear from all of
you.

James has kindly volunteered to make the "Secret Swami" available to
Minister Hagen's office.

There is still another possibility on how to approach this, but that
would
involve Ottawa and I think we need to concentrate on British Columbia
first.

Sanjay Dadlani systematically attacked me regarding my involvement on Wikipedia (in relation to the Sathya Sai Baba articles) for many months. Not only did Sanjay attack me on the SSB2 Yahoo Group, he created a blog (named "wikimoreno") that specifically targeted me based soley on my involvement with Wikipedia.

I first became aware of the Wikipedia user "Ekantik" back in September 2006 when he secretly and deceptively attempted to get Freelanceresearch (Lisa DeWitt) banned from Wikipedia behind her back (Refs: See Green Segments: 01, 02, 03, 04, 05, 06). I immediately suspected an Anti-Sai Activist and informed Lisa about it.

On November 19th 2006, Sanjay created the user-name "Gaurasundara" (a name he uses, and has used, on numerous forums and blogs). He created this user-name to vote to keep Robert Priddy's user-page (Ref). Since Sanjay only made two edits (at that time) under the name "Gaurasundara", I didn't give him too much attention and soon forgot about him.

Not too long thereafter, Ekantik began editing the Sathya Sai Baba Wikipedia article and immediately began attempting to bully me by repeatedly accusing me of using Wikipedia as a "battleground", "soapbox", etc., and began flaunting Wikipedia policy in my face like he was some sort of Admin. Consequently, knowing Ekantik's past history with Lisa, I decided to research his edits (which anyone can do at any time because one's edits are public domain).

Based on Ekantik's edits, it became very clear that "Ekantik" was into Gaudiya Vaishnavism and I immediately suspected he was Sanjay. I noticed that he added AC BhaktiVedanta Prabhupada as a "Notable person of the 20th century" (Ref), added "motorhead" on the same article (Ref) and made an edit regarding Lemmy Kilmister (Ref). Since Sanjay devoted an entire blog to Motorhead and Lemmy Kilmister (named "WhoreHouse Blog") and is a Gaudiya Vaishnava (with a blog named Gaurasundara's Musings and is an editor on Gaudiya Kutir Wiki), this all but convinced me that "Ekantik" was Sanjay. I promptly emailed Lisa with my suspicions although I still had some doubts because "Ekantik" claimed he had a basic speaking command of Telugu, French, German and Italian (which Sanjay never publicly professed knowing before).

Then I discovered two edits that confirmed my suspicions. Sanjay changed his name from "Ekantik" to "Gaurasundara" on two separate occasions (Refs: See Green Sections: 01 - 02). I promptly confronted Sanjay with these edits and filed a sockpuppetry claim against him on Wikipedia. After filing my complaint, Sanjay immediately went into a frenzy and attempted to do damage control by changing his name on his "Gaurasundara's Musing" blog from "Gaurasundara das" (a name he has used since August 2005) to "Dark Knight".

After counting his losses, Sanjay reverted his name back to "Gaurasundara das" and admitted on Wikipedia that he was using the sockpuppet-name of "Gaurasundara" (Ref). Sanjay clearly attempted to pass himself off as two separate editors (he even greeted his "Gaurasundara" sockpuppet with his Ekantik account: Ref). How's that for deception?

Further sticking his foot in his mouth, Sanjay Dadlani (aka "Ekantik" aka "Gaurasundara") claimed, while incognito, that he was not a POV (point of view) editor (Refs: 01 - 02 - 03) and claimed that the primary reason he began participating on the Sathya Sai Baba article was based soley because of various Requests For Comment (Ref).

Of course, these are blatant lies. Sanjay has a wholly critical and negative POV about Sathya Sai Baba (unremittingly referring to him, even to this day, as a "homosexual paedophile" 01, "faggot guru child rapist" 02, "murderer" 03, among numerous other defamatory slurs and libels). Sanjay had been keeping watch over the Sathya Sai Baba Wikipedia Article for many months and often criticized me about my edits there. Sanjay attempted to portray himself as someone who was not involved in the Sai Controversy and engaged me in debate incognito. When I revealed Ekantik/Gaurasundara's name as "Sanjay Kishore Dadlani", he threw one of his typical flaming, shrieking and girly hissy-fits, frothing at the mouth and posting all sorts of warnings on my user-page. Boo hoo!

Keeping in tune with Sanjay's pornographic inclinations, he put the following quote about pornography on his userpage:

Sanjay also has a userbox that states "This user rejects any violence towards women." Now read my article about What Sanjay Really Thinks Of Women and how he continually refers to women as "sluts" and "bitches". As a matter of fact, Sanjay made the following comments about women:

And to top it all off, Sanjay openly professed being filled with bitterness and poison, having a serious drinking problem, being scared that he was becoming "unstable and psychotic" (Ref), having a Jesus-Sex-Fetish (01 - 02) and wondered about cutting his flesh with razors and thought it would be "quaintly romantic" to purchase a gun, put it in his mouth, lick the barrel with his tongue and blow his brains out (Ref).

It is nothing short of absurd to think that the one of the most vocal defamers of Sri Sathya Sai Baba is free of ulterior motives and is dedicated to neutrality on Wikipedia in relation to Sai Baba. Funny enough, that is exactly what Sanjay (aka "Ekantik" aka "Gaurasundara") wants others to believe.

India’s President Dr. APJ Abdul Kalam has been the chief guest during the glamorous birthday show of controversial godman Sai Baba on 23rd November 2006. It is shameful and outrageous that the Indian President pays respect to a saffron charlatan, who exploits the gullible by claiming that he can produce ‘holy ash” from thin air, cure all illnesses, has created the universe and other nonsense more. It aggravates the case against President Kalam that he did not content himself with performing a kind of public relations routine, but went out of his way praising and glorifying the charlatan.

“I have immense love for Sai Baba”, Dr. Kalam said in his speech at Sai Baba’s headquarters in Puttaparthi . “I penned a poem in my mother tongue to greet Sai Baba on his birthday.” And he was not ashamed to read his poem (in a Telugu translation of the Tamil original) publicly to the cheering crowd of Sai Baba devotees. The rather embarrassing piece glorified Sai Baba as a glittering lighthouse and symbol of goodness. Because of Sai Baba’s presence, the President of India rejoiced, the earth was the most blessed planet in the solar system.

This is not only extremely silly and in bad taste. It is moreover irresponsible and undignified to a degree that is not compatible with the august office of the Indian President. President Kalam has misrepresented India and betrayed the trust of her people. India deserves a (more) dignified and responsible President.

It is deplorable that there are still many poor people in India, who are deprived of basic education and who don’t have any opportunity to develop scientific literacy. They are easy prey for frauds, fanning their fears and raising their hopes with “miracles” and promises of magical solutions for all problems. Miracle mongers and faith healers are inflicting a dangerous disease upon the weakest section of Indian society and have to be stopped by all means. It has to be one of the primary tasks of human development in India, to help the victims of superstition and blind belief to break the shackles of their archaic mindset and join the twenty first century.

Besides being the Indian President, Dr. Abdul Kalam is seen as one among the most prominent scientists of India and has raised great hopes for a better future, guided and protected by science. His concept “Vision 2020” promises to lead India smoothly into the orbit of the developed world. If a man of this stature and position uses his influence to come to the rescue a scandal-tainted godman, he commits a serious and unpardonable betrayal.

The children’s President & the alleged child abuser

In recent years, Sai Baba has hit international headlines as the center of another scandal. The aging godman stands accused of sexual abuse of minors among his devotees. Numerous cases of victims from India and abroad have come to light. Though Indian authorities seem still far away from opening a trial against the well-connected offender, too many victims and witnesses - mainly from Europe and USA - have broken their silence to further ignore his crimes. Some of their statements are recorded in articles that appeared in the London based The Daily Telegraph and in the film documentary "Seduced by Sai Baba", produced by the Danish State Television. In 2000, UNESCO washed its hands off Sai Baba by deciding neither to sponsor nor take part in a conference it had been planning to organize along with the Institute of Sathya Sai Education (ISSE, Thailand) and The Flinders University Institute of International Education (Australia), in Puttaparthi, India.

But all this seems not enough to stop President Dr. Abdul Kalam from publicly praising the fallen saffron star to the skies and lending him the shield of national honor to cover his shame. It is a shocking and somewhat macabre picture to see President Kalam, who loves to show himself in the company of children and cultivates an image of the great friend, promoter and protector of India’s youth, quite unperturbed and in such cordial relations with the man, who is held responsible for using his godly image to commit cruel and inhuman sexual abuse against hundreds of helpless minor devotees.

Philanthropy? A letter to the Indian President

Tainted and defeated, Sai Baba found a new avatar. One year back, on the occasion of his eightieth birthday, fans announced his transformation from miracle-man to philanthropist. Sai Baba's trust , which claims to be "the biggest NGO in the world after the United Nations", has allegedly spent millions of Dollars for drinking water, hospital and school projects around Puttaparthi (Andhra Pradesh) and in Bangalore (Karnataka). His down-to-earth development work is winning Sai Baba "even the hearts of non-believers", hoped his supporters.

In December 2005, I have written a letter to President Dr. Abdul Kalam, which was never answered. It demanded criminal investigations against Sai Baba. "If Sai Baba's social development projects are meant to be indulgence to nullify his crimes, this procedure is unprecedented and unacceptable", I wrote. "It is a shame for India that well-founded accusations and numerous reputed witnesses against Sai Baba are ignored without any investigation. Do saffron clothes make an offender untouchable for the law? Do we have to tolerate that political protectionism raises its head so boldly, mocking India's democracy?" I asked in my letter.

Spending a part of the great fortunes, swindled out of the gullible by pretending to have supernatural powers, for social development around his ancestral village doesn't make Sai Baba a great philanthropist. It is a well-known strategy of dacoits and gangsters, to build themselves a strong support base and a safe haven by winning the total loyalty of "their" villagers at home. Hasn't the cocaine mafia in Colombia done the same with their comparatively modest means? By the way, isn’t it a matchless irony that Sai Baba spends money, obtained by claiming the power to cure all illnesses, for super-specialty hospitals? Sai Baba himself, when he recently fell ill, preferred to be treated in one of his modern hospitals instead of relying on his own magic.

The people of India have a basic right to receive drinking water, appropriate medical care, education etc. It is the duty of any government to provide these essential goods. And it is an utter humiliation, if people are forced to receive their dues as alms from the hands of a "philanthropist" who expects them to bow theirs heads in front of him and praise his generosity. The situation becomes worse, if the government leaves the citizens in dependency of a "philanthropist", who is a criminal and a megalomaniac, and claims that he has supernatural powers and even created the universe. Sai Baba's birthday has become a day of national shame for India with a section of leading politicians, scientists and artists at the feet of a charlatan and alleged child abuser. If they express their devotion, because they are personally weak and gullible people, we have to ask ourselves why we don't elect confident, efficient, strong and intelligent politicians instead. If they do so because they want to celebrate the "benevolence" of a politically well-connected fraud and alleged criminal, they are deeply corrupt.

It is important to note that LSD was made illegal in the U.S. in 1968 (banned in California in 1966) so Ram Dass was carrying illegal drugs after that. Part of the reason I am bringing this up is because Ram Dass was and still is considered a "guru" by many yet you do not see ANY of these anti-guruites attacking Ram Dass who was a known druggie (some literature has even claimed Ram Dass was a black market dealer and mind control expert for the CIA)! When I First Came to India
"In 1967 when I first came to India, I brought with me a supply of LSD, hoping to find someone who might understand more about these substances than we did in the West. When I returned I emptied the vial of pills into my hand. In addition to the LSD there were a number of other pills for this and that--diarrhea, fever, a sleeping pill, and so forth. He asked about each of these.

He asked if they gave powers. I didn't understand at the time and thought that by "powers" perhaps he meant physical strength. I said, "No." Later, of course, I came to understand that the word he had used, "siddhis," means psychic powers. Then he held out his hand for the LSD. I put one pill on his palm. Each of these pills was about three hundred micrograms of very pure LSD--a solid dose for an adult. He beckoned for more, so I put a second pill in his hand--six hundred micrograms. Again he beckoned and I added yet another, making the total dosage nine hundred micrograms--certainly not a dose for beginners. Then he threw all the pills into his mouth. My reaction was one of shock mixed with fascination of a social scientist eager to see what would happen.

He allowed me to stay for an hour-- and nothing happened. Nothing whatsoever.

The whole thing had happened very fast and unexpectedly. When I returned to the United States in 1968 I told many people about this acid feat. But there had remained in me a gnawing doubt that perhaps he had been putting me on and had thrown the pills over his shoulder or palmed them, because I hadn't actually seen them go into his mouth.

Three years later, when I was back in India, he asked me one day, "Did you give me medicine when you were in India last time?"

"Yes."

The next morning I was called over to the porch in front of his room, where he sat in the mornings on a tucket. He asked, "Have you got any more of that medicine?"

Then he asked," Will it make me crazy?"

That seemed so bizarre to me that I could only go along with what seemed to be a gag.

So I said, "Probably."

And then we waited. After some time he pulled the blanket over his face, and when he came out after a moment his eyes were rolling and his mouth was ajar and he looked totally mad. I got upset. What was happening? Had I misjudged his powers? After all, he was an old man (though how old I had no idea), and I had let him take twelve hundred micrograms. Maybe last time he had thrown them away and then he read my mind and was trying to prove to me he could do it, not realizing how strong the "medicine" really was. Guilt and anxiety poured through me. But when I looked at him again he was perfectly normal and looking at the watch.

At the end of an hour it was obvious nothing had happened. His reactions had been a total put-on. And then he asked, "Have you got anything stronger?" I didn't. Then he said, "These medicines were used in Kulu Valley long ago. But yogis have lost that knowledge. They were used with fasting. Nobody knows now. To take them with no effect, your mind must be firmly fixed on God. Others would be afraid to take. Many saints would not take this." And he left it at that.

When I asked him if I should take LSD again, he said, "It should not be taken in a hot climate. If you are in a place that is cool and peaceful, and you are alone and your mind is turned toward God, then you may take the yogi medicine."--Ram Dass

This is the transcript of the conversation between Dr. Keki Mistry, an eminent consultant orthodontist and a long standing devotee from Mumbai, and Prof. G Venkataraman aired on Radio Sai a few weeks ago.

Prof. Venkatraman (GV): Sai Ram Doctor. It is very nice to see you here in the studio, which is a new Avatar of the building you have been used to long ago, when it was first constructed. [Earlier the Studio building was the EHV centre] It is a wonderful Studio, blessed by Swami and from this Studio, we have brought the experiences of so many devotees to people all over the world. It is now my pleasure to have you chat with us here. Could you introduce yourself briefly, tell us all about yourself, your professional career and how you came to Swami? All our listeners would be very happy to learn that.

“To Be Able to Speak is Itself a Miracle”

  
Dr. Keki Mistry (KM): Sai Ram to all of you. At the outset can I start by saying how I am very proud and privileged to be here with you Professor and in a program that bears Swami’s name. I am really honored to be here. My name is Dr. Keki Minochia Mistry. I am an Orthodontist practicing in the city of Mumbai for the last 45 years. I am in practice, I am in teaching, and I am in research. I have been Professor and Head of the Department at the Government Dental College, Mumbai. I have also been Dean and Director of Dental Studies of the D. Y. Patil University. Somewhere in 1965, I suddenly found I was losing my voice and I developed a very bad cough. I was coughing almost every second. I just couldn’t sleep or lie down. I had to spend nights sitting up just like this. Then I got myself examined, because a dry cough like that can be scary! They found that I had a lump in my throat – the size of a golf ball!

Every time I lay down I could not breathe properly, neither could I talk. The lump was so big that it interfered with my speech. I have been in practice since 1957, thought from 1961, I practiced as specialized orthodontist. When this happened in 1965, it meant the end of my professional life. Because every parent who brings their child for treatment wants to ask me questions and I just wasn’t able to answer them. The very fact that I am talking to you is a miracle of Baba.

I was brought up in a scientific environment; most of my relatives were doctors, scientists, professionals, lawyers, some of them leading lawyers in the city of Mumbai. The background in which I brought up had taught me that anything to do with any Baba or any person like that was a crutch. That was the bane of India. This was my thinking.

In 1964 somebody gave me a picture of Baba and some vibhuti. I was ill then. This was six months prior to my meeting Baba. I respectfully turned it down and said, “I don’t know who he is”. In 1965, I read Prof. Kasturi's book “Sathyam Shivam Sundaram” and I read it with a lot of interest. In fact, I read it through the whole night. I was thinking I was really grasping the stories.

‘Baba is Calling You’

  
I said to myself, ‘maybe I should meet Baba, maybe that miracle can happen to me.’ Then I heard that He was in Mumbai. And I was walking down the Hanging Gardens in Malabar Hills, when a young boy came and told me, “Baba is calling you.”

I said, “Who, Baba?” Just before that I must tell you six months ago when somebody gave me the picture of Baba, I had said to myself, “Who is this man with the red dress and fuzzy hair?”

So when this boy said to me, “You know that Baba with that big hair and red dress.”

I said, “Yes, I know Him.”

The he told me, He says to you, “Come to me.”

I went there and it was in the house of Mr. P. K. Savant. This was around 12 o clock in the afternoon. And it was a Ministers House, so police were there.

I had no knowledge of Baba or His routine. Baba had already given darshan and retired there. Police stopped me from going.

I said, ‘Baba has called me.’ They said “Who?” I turned around and said, ‘this boy…’ I turned around and looked, there was no boy!

I told the policeman, “Please let me go inside.”

The police looked at me and said, “You look like an cultured man, why are you doing this? Everybody wants to go inside.”

Somehow I wanted to stay. Half an hour passed and some policemen came to me and said, “You look like an educated person, why are you waiting here? Baba will not come out now. You go to Gwalior garden darshan at 4 o-clock. Baba is not going to come here just now, before 4 p.m. ”

Still I waited. It was May, very, very hot. And it used to be very hot in Mumbai. I waited, somehow or other. About at quarter to 2, I decided that I will wait till 2 p.m. If Bhagavan Baba doesn’t come out, then I will go back home.

It was too hot then and I stayed in the sun for almost two hours, and I wasn’t keeping well.

About 5 minutes to 2 p.m, Baba came out of the window on the first floor.

He looked directly at me and said, “Come.”

 
 
Now, the policemen’s back was to the window and I was there across the road. I rushed. Around me there were two other ladies. I thought they were widows because they had white sarees on. They also came. They also saw Baba. I didn’t know whom Baba called – me or them? But I went.

The policemen again told me, “What is this nonsense?”

I said, “Baba really called me, from the window.” But Baba was no more there. I looked around. Again no one! But Swami came downstairs to the ground floor. Then of course the policemen let me inside!

The ground floor was on a level, slightly higher than the floor of the compound wall. And I stood there, when I saw Him for the first time, I was not crying. But then tears coming down my eyes, just flowing. I was embarrassed. There were those ladies who followed with me inside and in front of these women, I am crying or what? It was actually a flow of water, like a river. Swami was standing and looking at me sweetly. Tears fell at His feet. I felt very comfortable with Him. He was at the verandah, at a height of 3-4 feet, and I was on the downstairs.

And then He takes a look at me, talks to me and says “Kal Ma ko Leke Aana Maa ka thabeeyath teek nahi hai. [Get your mother and come tomorrow. Her health is not good].” My Mother has not been well, being a chronic asthmatic. So I said, “OK.”

“Tomorrow 9 o’clock, please come,” he said again.

I said, “Swami nobody is allowing me to come.” He, then, spoke to someone and they gave me permission for two people - myself and my mother.

I went home and Mother was very happy. She was spiritually very involved all the time. So if Swami had called me, he had called 200 other people too. And it was a huge gathering of 200 other people all in stages of sickness.

I distinctly remember one girl of 11 or 12, moaning away, because she is supposed to have a tumour in her head. We were all sitting down. When Swami came out in a room and He called us inside, like in the interview room, I had no knowledge of all this. I thought it would be like a doctor’s room. I was called in fourth and I went with my mother.

Swami stood there and He talked to my mother and said, “You have got asthma. You have difficulty in breathing.” Anyone looking at Mummy could tell she had asthma. She had the asthmatic build, gasp for breath and everything else. But she wasn’t interested about herself at all.

So she said, “Swami, What about him?” Now look, I was looking normal. The throat wasn’t showing anything. But He said, “I know Ma. Upar Lump hai. (yes, there is a lump on the top). Negative, Positive thoughts. Operation kare, na kare? (whether to do operation or not?)”

So mother asked Him the million dollar question: “Does he have cancer or not?”

With great authority Baba said “Cancer? He cancer? He is not your son, He is my boy. He has only come through you. No Cancer. He cannot have cancer.”

Then Swami waved his hand and materialized a lot of ash in mother’s hand. She said, “What should I do?” We have never seen anything like this sacred ash before.

He said, “Kha Jao.” (“Eat!”) She gulped all of it. He took me aside and said, “Do not worry. You go and pray, in 3 days you will be alright.”

I was very spiritual that way. I used to believe in prayers and divinity a lot, except that I could not believe in any human being divine.

GV: When you say you pray a lot, you mean you prayed in the Parsi way?

KM: Yes, according to the faith I was brought up. I had a thing about going to the fire temple. I used to go 3-4 times a week even as a school boy. This was my nature. When I say prayer, I didn’t really know any formal language nor the Avestan language, and I didn’t like to pray in a language which I didn’t know. I used to just go to the temple and communicate.

  
He said go on praying. Then He dismissed us. We went away. I went home and realized all this time coming from Swami and reaching home, for 30 minutes, I had not coughed. I suddenly became all right. My cough stopped, I could sleep. I thought psychology or hypnosis was at work. Two-three days later, Swami left Mumbai.

I didn’t show myself to a doctor. At this stage I must tell you that some of the leading cancer specialists had all seen me and it was documented that they should get this lump out. “It will interfere with your breathing.” “We don’t know if it is cancer.” “We can tell that only after the biopsy.” “It is getting bigger.” “You must get it out.”

I didn’t show myself to any doctor after Swami left. Six months passed, I was completely cured, symptoms had all disappeared. I had no physical checkup, no authenticity whether that tumor was there or not. Approximately six months later, I had a severe coughing bout. I spat blood. I was very scared. I went to the ENT surgeon, who is still alive at the age of 90 plus. I said, “Dr Heeru, Please see me.”

He said, “You are very tense, I can’t examine you. Have you had anything since the morning?” “No, I just woke up and came here. I haven’t even had a cup of tea.” After that he administered me anasthesia, a small induction, and then said, “Tell me what has happened? This is beautiful. There is nothing there, there is no tumor. How did you get it removed? What did you do? Who did you show to?”

Then I told him the whole story. He listened to this very intently and said, “Yes, I have heard cures about Him. You are very lucky. I have seen cures like this. Go, you are a very blessed man!”

So, that was my authenticity.

A Change Occurs Both Inside and Out

GV: At that point you believed it was a sort of psychosomatic phenomena, how did you change your view? How did the full faith and confidence come to you?

KM: I am glad you asked me this. That same evening I saw Baba, I went to the temple after I went to Baba. I prayed to Zoroaster, said, “Show me a sign? Is this really someone who saved me or is it a fluke? I want to see a sign.” And then in the evening, I went to His darshan meeting in Gwalior Palace. It was a huge gathering and from where I sitting Swami was looking like a tiny speck and I was hoping that He would come towards me. But I was almost at the last row and in a place where Swami would normally not come. And Swami came almost half way into the crowd and then He turned back towards the podium. But suddenly He turned. And made a beeline towards me. There was a rock there towards the end of the ground and I was sitting on the rock. He came very near me, put His hand on my shoulder and said, “Don’t push too hard.” I did not know what that meant but I took it as a sign. I said, “Why among the entire huge crowd He asked me?” All the other people started asking me, “Does he know you? From then on, many things happened. My wife was pregnant with my first child, nobody in the family knew about it, except her mother and my mother. I said, “Nothing”. But I must tell you, my wife had developed a funny problem of spitting. Every second she used to spit and that used to drive her crazy. She had tremendous salivation and it used to flow. So suddenly I remembered about my wife and said, “My wife…”

Swami cut me immediately and said, “Malum hai, Sir, Garbh” (I know, Sir, she is pregnant)

Mind you, she was 700 miles away. He said, “Do not worry, August 22, you will have a son.”

I didn’t ask Him anything.

Then He said something else. “Chiranjeevi - Long Life!”

Then all the doctors went away. I went home and my wife said, “I want to tell you something. I am not spitting, salivating.” I asked her went did it stop and I traced out that exactly at the moment I talked to Swami, she stopped.

To cut a long story short, I got a son. Swami did materialize a fruit during that conversation. It was a dry date. “A few hours before your wife goes for the hospital, you make her eat that fruit,” He had said. We religiously did that for her and on August 22, just as Baba had told, my son was born.

GV: Amazing!

KM: I went to visit my son in the hospital on the 3rd day and my son’s bilirubin had shot up to 10-11. If bilirubin shoots up, it can cause the brain to be damaged. They were taking the blood from the skull of the infant and seeing the count. My wife almost fainted watching this. She didn’t know what was wrong and in her mind she said, “They are taking blood from the skull”. It upset her but at the same time she was strong. The bilirubin sometimes went up to 10-13, but she said, “Don’t worry. Swami told you Chiranjeevi (Long life). He will live.” When Swami had said Chiranjeevi, I had thought it was a kind of casual blessing. Now I knew the significance. So we kept the confidence and he recovered. They found that in Parsis, the G6PD blood deficiency is common. He was born with the blood deficiency. This incident almost strengthened our faith quite a bit.

My wife was no way near Swami and she was 700 miles away, no one knew that she was pregnant. We did not discuss this with anyone. But He said everything. I wasn’t even thinking about her pregnancy during that interview.

GV: Your narration is so fascinating, I have to ask you for more.

KM: I have seen so many things now, being with Swami for 40 years. I saw a person, a Sindhi gentleman, who was a printer from Madras, being declared dead. Swami used to ask me to go and work in the general hospital in Puttaparthi whenever I used to come here. One night, Dr Bhaskar Rao from Andhra Pradesh and myself were sleeping, as part of our duty near the bed of a patient.

This person was almost declared dead. The whole family was called from Madras (now Chennai). At about 12 o clock in the night, Dr. Bhaskar Rao wakes me and says, “Did you smell something very fragrant?” [Incidentally, this incident has been written about in Sanathana Sarathi, in the late 1960s.]

Dr. Bhaskar Rao woke me up. It was a very strong fragrance of vibhuti - it was very fascinating. This was the man almost dead! But nothing happened, we just got the smell. The next morning we went for our bath.

And when we returned – it must be about 6 o'clock in the morning - we saw this man sitting up on the bed and singing Raghupathi Raghava Raja Ram! I almost fainted. It was so funny, it was so fascinating. This man who is almost dead, singing Raghupathi Raghava Raja Ram!

The Divine Blesses The Dutiful

Now, to tell you another interesting tale, my mother had absolute devotion to Baba. For her, Baba was ‘the thing’. Nothing was in between her and Baba. One day while I was talking with her, she stood up and turned to go to the kitchen. I saw a big red blob on her backside. It was blood. I said, “What is this?” “I have been bleeding often,” she said. I got very upset. “You don’t even tell me, how would I know you are bleeding from your rectum?” We found out that she had cancer of the rectum. She told me, “Go and tell Swami”. So I went to Baba. I went to Whitefield but Baba was in Kodaikanal. I said, “OK, I will stay here for a while and then go back”. But Mr. Ramabrahman, the caretaker of Whitefield ashram, told me, there was a phone call from Swami. “Dr. Mistry is there, tell him not to go, I will come in the evening” – that was the message from Him. So I stood by. When He came, I told Swami about mother’s cancer. Swami then looked at me directly in the eye and said, “What doctor, should people live forever?” I, then, realized that it was His way of saying she was going to die.

Then I said, “Swami, as a son, I would request you that she should have a peaceful death.” “Peaceful death mangtha hai? Jao Milega,” [You want for her a peaceful death? Go, you will get that] He said, as if it was something He was giving out.

  
You should know how to talk to Bhagavan Baba. We ask him what we think we need. I just asked for a peaceful death. I should have asked for a peaceful whole life towards the end. The last week of her death was extremely peaceful, but not before that. She was neither here nor there. She wouldn’t allow anyone to touch her, except me. She kept on saying, “My Prince,” and asked me all funny things. She asked, “Without a dog, can a man enter the kingdom of heaven?” I told her the vedic story of how the king and the dog were refused entry. It was completely out of blue. She used to sing, say some hymns and things like that, which completely befuddled us. She had no knowledge. She was talking in tongues, which was totally new to us and completely new to her as an individual. I remember during her last moments, I was standing at the foot of her feet. She was lying there, raised her hands and then waived as if she was bidding goodbye and then closed her eyes. She had a peaceful death.

I told later to Swami about her end. I said that mother was talking in all kinds of languages and her end was very peaceful. Swami took it as a matter of course. But let me tell you, Swami had visited Bombay during her illness. She was admitted in the Parsi General Hospital. And I was one of those persons Swami asked to be with Him whenever He came to Bombay (now Mumbai). There were a few others like Inamdar and Satheesh, and Swami used to allow us to be in His room. We did everything - draw His water, take out His clothes, serve Him food, etc. all things an attender would do. We were on duty and I was staying in Dharmakshetra (Swami’s residence in Mumbai) itself, full 24 hours. I didn’t go anywhere.

Other people used to ask me, “What about your practice?” But I used to feel very happy doing this and He used to allow me to do this. Now, one night - it was a Friday, I remember at 8 o'clock - mother was very ill and she was in the hospital. A call came from my father that the doctor says she is very serious and may not live through the night. So I asked my father, “Is she asking for me?” He said, “No. She is not conscious at all.” I said, “If she is not asking for me father, do you feel that I should be there with you, because I am on duty.” Swami retired at 8 pm. I cannot leave without Swami’s permission. I don’t feel like leaving, I haven’t spoken to Baba and I can’t knock on the door now. I wouldn’t do that.

My sister came on the phone and she said, “What, nonsense?” I got a firing from her. I said, “Fine, give the phone back to father.”

I asked Father, “Do you need me there?” He said, “No!” So I decided I will stay at Dharmakeshtra and pray for her. If she was asking for me, then it would be something else. Her doctor, who was a leading surgeon of Mumbai, too came on the phone and said, “Keki, I don’t think she will make it through the night. It is up to you, it is your mother. Folks are asking me to talk to you.” I said, “Ok”. But then, this is the stand I took – I will stay at Baba’s residence.

Swami was not there and I could not leave without His permission - particularly when she was not asking for me. Next morning at 7, Swami opened His door and I went inside. Swami sat down and was looking at some paper. I said, “Swami there was a call. Mother is not very well, can I have your permission to go?”

A Special Visit with Swami

  
Now, this was Saturday morning. He said, “Wednesday I am visiting Savant’s house and your mother is in the hospital close by. Let us go together to visit her.” She lived four days. I took it as a sign that I should not go. My family had a reaction, not my father. By that time, she recovered consciousness. Mother said, “No, let him be with Baba.”

On Wednesday, Swami went to the Hospital – the Parsi General Hospital - to see her with me. Normally, I used to travel in the car with Him wherever He went. I would sit in the front and Sri Indulal Shah would sit next to Swami at the back. So, I went with Him.

When mother saw Swami in the hospital, she looked at Swami and asked,

“What is the matter with you? You, coming to see this old lady? Thousands of people are waiting for your darshan and you are wasting your time here.”

Swami then knocked me and said, “See, this is called bhakthi (devotion)”. Swami was showing me what true devotion is!

She said, “You left all the thousands of people for darshan and you have come to see old lady.” At the same time, she was very conscious of herself as a host. “Please seat yourself,” she said and then took some coconut water. Swami said, “I am not the patient” and asked her lie down immediately. She had been operated upon - Colostomy was done – and Swami created and applied vibhuti on her. He talked to her for 10-15 minutes.

Now imagine this. Doctor said, “Come immediately, she will not live through the night.” But Swami said, “We will see her on Wednesday.” My mother came home from the hospital and lived for another one and half years after that. She died in our home.

GV: You seem to have a fund of astonishing stories.

KM: This is only a tip of the iceberg!

Ah, People need a lot of patience to read through this/m2392.It is a story of how even Doctors can be made fool of.first of all he went there as a devotee,who had read all the lies in sathyam sivam sundaram.So it is no surprise.By the way what about all the devotees of Amrithanandamayi maa,KalkiBhagavan,Bangaru adigalar and all the new ones whose names are still.How many avtars at the same time.I think we have enough Avatars to send one to each devotee. With my experience in Puttaparthi,I think I can do a good job.

I agree that Sai Baba is clairvoyant sometimes.But I have seen at least three such people and heard of ten such people.If you want to be one practise meditaion on your agnya chakra for at least 3 to 4 months and you can become sai baba.One more thing,Seshama raju(elder brother of baba) also had powers like sai baba. This was mentioned by Phani Kumar,his grand son and many others.So can we make them both divine incarnations.Most of Baba' predictions don't come true.A few do come true and I had a family friend who used to predict like Baba.there was student's father in parthi who used to predict too.Even ordinary people like us get intuitive thoughts.I know of a friend who declared suddenly " there is an earth quake right now in some place and many people have died." He was himself taken aback by this.In three hours we got the news of the earth quake in California or Mexico(I forgot.It was in 198 1986 or 87 i think) So can we call all these people Avatars??

Sexual molestation charges

Canada
Allegations of sexual abuse at Mount Cashel orphanage in Newfoundland led to a royal commission (The Hughes Inquiry). Further investigations followed into allegations at other institutes across Canada.

The Hughes Inquiry concluded that officials had transferred offenders and covered up the sexual abuse at Mount Cashel, and recommended that the victims be compensated. There was insufficient evidence to charge church and government officials with obstructing justice. Nine Christian Brothers were eventually convicted and sentenced to between one and 13 years in prison. These include Edward English, Edward French and Joseph Burke amongst others.

The orphanage was closed in 1990, and on April 5, 1992, the Christian Brothers formally apologized to the victims of abuse at Mount Cashel.

The fight to compensate the victims of Mount Cashel lasted for many years. In 1996 the Newfoundland government paid $11.5 million in compensation. The courts ordered the assets of the Christian Brothers sold to compensate the victims, who were to receive between $20,000 and $600,000 in compensation.

In 2002 St. Thomas More Collegiate in Burnaby and Vancouver College in Shaughnessy paid victims $19 million in an out-of-court settlement.


United Kingdom and Ireland
In March 1998, the Congregation of the Christian Brothers published full-page advertisements in newspapers in Ireland (but not the UK), apologising to former pupils who had been ill-treated whilst in their care. The unprecedented advertising campaign expressed "deep regret" on behalf of the Christian Brothers and listed telephone lines which former pupils could ring if they needed help.[1]


Australia
In the 1970’s Ballarat was considered one of the pillars of the Australian Catholic Church and St Patrick’s College was the spiritual heart of Ballarat. However paedophiles operated with impunity across the Senior and Junior schools of the College. The abuse was widespread and well known within the church hierarchy.[2]

As early as 1971 the now retired Bishop Mulkearns took the halfhearted step of dealing with the problem referring probably the worst St Patrick’s College paedophile, Fr Gerald Ridsdale for counselling. Predictably this strategy did not stop the abuse. Fr Ridsdale went on offending with his most horrific years of inflicting paedophilia abuse ahead of him.

Fr Ridsdale was later convicted of 46 counts of sexual abuse against 21 victims over two decades. His victims claim that he would select children from the class and rape them with impunity either in the presbytery or a public toilet. In one instance he raped a young girl who came to him for comfort on the day of her father’s death. In 1994, Bishop Mulkearns claimed that while he was aware of the abuse, he was not aware of the extent.

The convictions are probably only the tip of the iceberg. Ridsdale has admitted that his victims can be counted in the 100s and further charges are currently being considered by Victoria’s Director of Public Prosecutions.

One of the St Patrick’s College junior campuses, East Ballarat's St Alipius Primary School (now closed) had a particularly active paedophile ring. In the four classrooms there was Brother Robert Best, Brother Edward Dowlan, Brother Fitzgerald, (now dead) and Brother Stephen Francis Farrell. All, except Fitzgerald, were later convicted of sex crimes. During Dowlan's County Court trial in 1996, the prosecution alleged that three St Alipius boys were each sexually abused by Dowlan, Best and Ridsdale.

Dowlan and Best were later transferred to the senior school where they joined other College pedophiles and continued to offend. Only very reluctantly has the Church come to accept its complicity in these crimes and the culture of abuse continues to divide this otherwise peaceful country town. These two covicted felons continue to work in the Christian Brother's various ministries.[3]

Usedaccuser apparently doesn't understand (or thinks everyone is stupid) there is such a thing as racism and bigotry within the same group (roll eyes).
