Landmark ruling for child sex abuse vicitms

Adult survivors of child abuse can now sue their attackers for civil damages, even decades after it happened.

With this watershed judgment, the Supreme Court of Appeal has opened the doors for civil recourse for thousands of abuse survivors who had often been left without help, because previously, victims could not lay a charge for rape and child abuse if the crime happened more than 20 years earlier.

The application was brought by a Esme van Zijl, who was raped, sodomised and indecently assaulted by a relative more than 40 years ago.

In their judgment, the court has also recognised a well-known psychological phenomenon that adult survivors of child abuse sometimes take a long time to recognise that what they had suffered was not their fault.

'Abused children have a right of recourse against their abusers'The judgment, written by Justice of Appeal Jonathan Heher, brought South Africa on a par with the US, Australia, New Zealand and Canada in the recognition of the rights of adult survivors of child abuse.

Van Zijl, 51, wants to sue her relative, who is a retired businessman, so that she can pay for the extensive therapy she needs to overcome the serial rape and abuse she had allegedly suffered at his hands.

She claims that she was sexually abused, raped and sodomised by him between 1958 and 1965, starting when she was six years old.

In terms of the law, as it was before Monday's judgment, she should either have sued him within three years of the date that he first abused her, or in 1973, the year she turned 21. But Van Zijl became aware of the effect of abuse on her psyche, personality and ability to function as a person only in 1997.

"Abused children have a right of recourse against their abusers," Judge Heher said in his judgment.

'The law no longer conspires with perpetrators of child abuse to silence victims'"Until the 1980s, the right was seldom invoked and, in South Africa, probably not at all. Major reasons were cultural or societal taboos (many abusers are close family members), and ignorance.

"Since then, the boundaries of understanding of the psyche of survivors of child abuse have been pushed back by expert studies of the problem, and the true nature and extent of the effects of such abuse has been become better appreciated.

"As survivors have become more informed about their condition and rights, and have received support from public interest groups, there has been an upsurge in claims, many by adults who initiated proceedings years after the actual incidents.

"This, in turn, has given rise to a spate of cases, particularly in the United States, in which defendants have invoked limitations statutes," Judge Heher said.

"This is the first case of the kind in South Africa of which I am aware," he added.

He said society as a whole was, during the period prior to 1980, more conservative in matters involving sexual mores than it is now, and considerably less willing to confront sexual matters.

"Approaching the (case) as if it were akin to discovering cracks in a house foundation, does not demonstrate any great... sensitivity to the psychological and emotional problems suffered by a woman."

Michelle O'Sullivan, the director of the Woman's Legal Centre, which handled Van Zijl's case, said the case would affect how future cases of child sexual abuse would be handled by the courts.

"Other survivors will now be able to bring claims knowing that the law has developed an appreciation of the psychological obstacles that prevent adult survivors from bringing claims.

"The law no longer conspires with perpetrators of child abuse to silence victims by preventing survivors from claiming damages later in life, as it is now recognised that it is the abuse itself that often prevents a survivor from taking action. Abusers will not be able to rely on the Prescription Act to avoid such claims," she said.

I want to thank Matt Clarke for taking my call this morning and to
share the
advice received from him.

As you all know, Canada has the distinction of having a tougher duty to
report law when it comes to child abuse and I have also recently
learned
there is no statute of limitations for prosecuting child sexual abuse
in
Canada no matter when it occurred.

That being the case, we still live in the real world of budget and
resource
limitations and according to Matt, if we really really want the
Minister of
Children and Family Development to take investigative action, we need
to be
able to furnish a list of specific names of British Columbia children
under
the age of 18 who are most vulnerable to being taken to India to see
Sathya
Sai Baba.

Some of them may already have been abused and of course, that would be
most
helpful to know as well.

After several discussions, I finally realized there is one person in
particular who would be most likely to be able to produce such a
list...namely Susan
Susan was a Bal Vikas teacher at the Vancouver Center for 25 years up
until
2001 and could strongly be presumed to have such a list. She would also
most
likely be able to tell or find out who are the current Bal Vikas
teachers at
the center.

Being in a position of care for children, emergency situations alone
would
dictate that she would have access to the names of all the children at
the
center and their parents address, telephone numbers etc...and possibly
even
a complete list of all the devotee members of the center.

Now the question is, what is the best approach to Susan?

It is my understanding that her current marriage partner may not
encourage
her to become involved in helping us, yet he and Susan did attend along
with
several other former devotees known to Mr. Danis a screening of the
"Secret
Swami" before it actually aired in Canada.

Perhaps a direct request from Matt might do the trick.

In any event, I am asking James to make Susan's phone number and
address
available to Matt and myself (I lost it when my computer database
crashed)
and I would appreciate hearing from any of you with your suggestions.

I do not want this opportunity to slip away and I agree with Matt that
we
need to furnish specific names to insure that our request to Minister
Hagen
and the other Ministers will not be ignored or side tracked.

Another possibility would involve the names, particularly of Sikh
children
under the age of 18 in the Delta Surrey areas of Greater Vancouver.
According to Tony, many of them already claim that SSB is a pedophile.
That
means their parents know and that their parents need to report what
they
know.

My rough draft to Minister Hagen is almost ready to send, but after
talking
to Matt this morning I will wait sending it until I hear from all of
you.

James has kindly volunteered to make the "Secret Swami" available to
Minister Hagen's office.

There is still another possibility on how to approach this, but that
would
involve Ottawa and I think we need to concentrate on British Columbia
first.

Sanjay Dadlani systematically attacked me regarding my involvement on Wikipedia (in relation to the Sathya Sai Baba articles) for many months. Not only did Sanjay attack me on the SSB2 Yahoo Group, he created a blog (named "wikimoreno") that specifically targeted me based soley on my involvement with Wikipedia.

I first became aware of the Wikipedia user "Ekantik" back in September 2006 when he secretly and deceptively attempted to get Freelanceresearch (Lisa DeWitt) banned from Wikipedia behind her back (Refs: See Green Segments: 01, 02, 03, 04, 05, 06). I immediately suspected an Anti-Sai Activist and informed Lisa about it.

On November 19th 2006, Sanjay created the user-name "Gaurasundara" (a name he uses, and has used, on numerous forums and blogs). He created this user-name to vote to keep Robert Priddy's user-page (Ref). Since Sanjay only made two edits (at that time) under the name "Gaurasundara", I didn't give him too much attention and soon forgot about him.

Not too long thereafter, Ekantik began editing the Sathya Sai Baba Wikipedia article and immediately began attempting to bully me by repeatedly accusing me of using Wikipedia as a "battleground", "soapbox", etc., and began flaunting Wikipedia policy in my face like he was some sort of Admin. Consequently, knowing Ekantik's past history with Lisa, I decided to research his edits (which anyone can do at any time because one's edits are public domain).

Based on Ekantik's edits, it became very clear that "Ekantik" was into Gaudiya Vaishnavism and I immediately suspected he was Sanjay. I noticed that he added AC BhaktiVedanta Prabhupada as a "Notable person of the 20th century" (Ref), added "motorhead" on the same article (Ref) and made an edit regarding Lemmy Kilmister (Ref). Since Sanjay devoted an entire blog to Motorhead and Lemmy Kilmister (named "WhoreHouse Blog") and is a Gaudiya Vaishnava (with a blog named Gaurasundara's Musings and is an editor on Gaudiya Kutir Wiki), this all but convinced me that "Ekantik" was Sanjay. I promptly emailed Lisa with my suspicions although I still had some doubts because "Ekantik" claimed he had a basic speaking command of Telugu, French, German and Italian (which Sanjay never publicly professed knowing before).

Then I discovered two edits that confirmed my suspicions. Sanjay changed his name from "Ekantik" to "Gaurasundara" on two separate occasions (Refs: See Green Sections: 01 - 02). I promptly confronted Sanjay with these edits and filed a sockpuppetry claim against him on Wikipedia. After filing my complaint, Sanjay immediately went into a frenzy and attempted to do damage control by changing his name on his "Gaurasundara's Musing" blog from "Gaurasundara das" (a name he has used since August 2005) to "Dark Knight".

After counting his losses, Sanjay reverted his name back to "Gaurasundara das" and admitted on Wikipedia that he was using the sockpuppet-name of "Gaurasundara" (Ref). Sanjay clearly attempted to pass himself off as two separate editors (he even greeted his "Gaurasundara" sockpuppet with his Ekantik account: Ref). How's that for deception?

Further sticking his foot in his mouth, Sanjay Dadlani (aka "Ekantik" aka "Gaurasundara") claimed, while incognito, that he was not a POV (point of view) editor (Refs: 01 - 02 - 03) and claimed that the primary reason he began participating on the Sathya Sai Baba article was based soley because of various Requests For Comment (Ref).

Of course, these are blatant lies. Sanjay has a wholly critical and negative POV about Sathya Sai Baba (unremittingly referring to him, even to this day, as a "homosexual paedophile" 01, "faggot guru child rapist" 02, "murderer" 03, among numerous other defamatory slurs and libels). Sanjay had been keeping watch over the Sathya Sai Baba Wikipedia Article for many months and often criticized me about my edits there. Sanjay attempted to portray himself as someone who was not involved in the Sai Controversy and engaged me in debate incognito. When I revealed Ekantik/Gaurasundara's name as "Sanjay Kishore Dadlani", he threw one of his typical flaming, shrieking and girly hissy-fits, frothing at the mouth and posting all sorts of warnings on my user-page. Boo hoo!

Keeping in tune with Sanjay's pornographic inclinations, he put the following quote about pornography on his userpage:

"Wikipedia is one of two good things on the internet. The other is porn." ~CaughtThinking (Ref)

Sanjay also has a userbox that states "This user rejects any violence towards women." Now read my article about What Sanjay Really Thinks Of Women and how he continually refers to women as "sluts" and "bitches". As a matter of fact, Sanjay made the following comments about women:

Fucking bitches, they owe me something. And every day that passes ain't helping their fucking case. Oh boy, am I getting madder and madder by the day. Oh boy, am I gonna burn them alive or what?

Fucking women, I decided today that I think all "hot" women fucking can go fuck themselves. Fucking snotty bitches, fucking little teasers, they can go die. Little bitches, brought up as sluts. fucking shitty females, my ass. They can go die.

Women as a whole are really starting to piss me off. Why don't they just go and fuck off? You either get "hot" women who prance about thinking that they're all that and how incredibly lucky you are to even be in their presence, or you get the ugly bitches whose tongues hang out for you all over the floor.

Usually I treat girls like the fucking sluts that they ARE.

Not only did Sanjay make these comments, he created a StreetBitches Blog where he stalked women and filmed them with his digicam under tables and up their dresses and which was aptly entitled "They Want It: Everywhere I Look, I See Bitches". Needless to say, another webmaster (a Gaudiya Vaishnava often praised by Sanjay) also caught Sanjay engaged in his deviant behavior on the StreetBitches Blog and wrote an email for me to forward to University officials to support my claims.

Sanjay believes that because I used the word "poo", I have some sort of "fascination for faecal material" and am a "toilet sex pervert". Well, Sanjay apparently suffers from the same "fascination for faecal material" and is a "toilet sex pervert" becuase he often uses the words "shit" and "bullshit". I discussed this in my blogged article entitled Sanjay's Disgusting Feces Obsession. Funny enough, Sanjay has a user-box on his user-page that states:

This person does not understand Bullshit (or understands it with considerable difficulties or does not wish to communicate in Bullshit).

As a matter of fact, the "bullshit" user-box was the first user-box that Sanjay included on his user-page (Ref). Sanjay, what is that again about people having "fascinations for faecal material" and being "toilet sex perverts" for simply using words that refer to feces?

And to top it all off, Sanjay openly professed being filled with bitterness and poison, having a serious drinking problem, being scared that he was becoming "unstable and psychotic" (Ref), having a Jesus-Sex-Fetish (01 - 02) and wondered about cutting his flesh with razors and thought it would be "quaintly romantic" to purchase a gun, put it in his mouth, lick the barrel with his tongue and blow his brains out (Ref).

It is nothing short of absurd to think that the one of the most vocal defamers of Sri Sathya Sai Baba is free of ulterior motives and is dedicated to neutrality on Wikipedia in relation to Sai Baba. Funny enough, that is exactly what Sanjay (aka "Ekantik" aka "Gaurasundara") wants others to believe.

India’s President Dr. APJ Abdul Kalam has been the chief guest during the glamorous birthday show of controversial godman Sai Baba on 23rd November 2006. It is shameful and outrageous that the Indian President pays respect to a saffron charlatan, who exploits the gullible by claiming that he can produce ‘holy ash” from thin air, cure all illnesses, has created the universe and other nonsense more. It aggravates the case against President Kalam that he did not content himself with performing a kind of public relations routine, but went out of his way praising and glorifying the charlatan.

“I have immense love for Sai Baba”, Dr. Kalam said in his speech at Sai Baba’s headquarters in Puttaparthi . “I penned a poem in my mother tongue to greet Sai Baba on his birthday.” And he was not ashamed to read his poem (in a Telugu translation of the Tamil original) publicly to the cheering crowd of Sai Baba devotees. The rather embarrassing piece glorified Sai Baba as a glittering lighthouse and symbol of goodness. Because of Sai Baba’s presence, the President of India rejoiced, the earth was the most blessed planet in the solar system.

This is not only extremely silly and in bad taste. It is moreover irresponsible and undignified to a degree that is not compatible with the august office of the Indian President. President Kalam has misrepresented India and betrayed the trust of her people. India deserves a (more) dignified and responsible President.

It is deplorable that there are still many poor people in India, who are deprived of basic education and who don’t have any opportunity to develop scientific literacy. They are easy prey for frauds, fanning their fears and raising their hopes with “miracles” and promises of magical solutions for all problems. Miracle mongers and faith healers are inflicting a dangerous disease upon the weakest section of Indian society and have to be stopped by all means. It has to be one of the primary tasks of human development in India, to help the victims of superstition and blind belief to break the shackles of their archaic mindset and join the twenty first century.

Besides being the Indian President, Dr. Abdul Kalam is seen as one among the most prominent scientists of India and has raised great hopes for a better future, guided and protected by science. His concept “Vision 2020” promises to lead India smoothly into the orbit of the developed world. If a man of this stature and position uses his influence to come to the rescue a scandal-tainted godman, he commits a serious and unpardonable betrayal.

The children’s President & the alleged child abuser

In recent years, Sai Baba has hit international headlines as the center of another scandal. The aging godman stands accused of sexual abuse of minors among his devotees. Numerous cases of victims from India and abroad have come to light. Though Indian authorities seem still far away from opening a trial against the well-connected offender, too many victims and witnesses - mainly from Europe and USA - have broken their silence to further ignore his crimes. Some of their statements are recorded in articles that appeared in the London based The Daily Telegraph and in the film documentary "Seduced by Sai Baba", produced by the Danish State Television. In 2000, UNESCO washed its hands off Sai Baba by deciding neither to sponsor nor take part in a conference it had been planning to organize along with the Institute of Sathya Sai Education (ISSE, Thailand) and The Flinders University Institute of International Education (Australia), in Puttaparthi, India.

But all this seems not enough to stop President Dr. Abdul Kalam from publicly praising the fallen saffron star to the skies and lending him the shield of national honor to cover his shame. It is a shocking and somewhat macabre picture to see President Kalam, who loves to show himself in the company of children and cultivates an image of the great friend, promoter and protector of India’s youth, quite unperturbed and in such cordial relations with the man, who is held responsible for using his godly image to commit cruel and inhuman sexual abuse against hundreds of helpless minor devotees.

Philanthropy? A letter to the Indian President

Tainted and defeated, Sai Baba found a new avatar. One year back, on the occasion of his eightieth birthday, fans announced his transformation from miracle-man to philanthropist. Sai Baba's trust , which claims to be "the biggest NGO in the world after the United Nations", has allegedly spent millions of Dollars for drinking water, hospital and school projects around Puttaparthi (Andhra Pradesh) and in Bangalore (Karnataka). His down-to-earth development work is winning Sai Baba "even the hearts of non-believers", hoped his supporters.

In December 2005, I have written a letter to President Dr. Abdul Kalam, which was never answered. It demanded criminal investigations against Sai Baba. "If Sai Baba's social development projects are meant to be indulgence to nullify his crimes, this procedure is unprecedented and unacceptable", I wrote. "It is a shame for India that well-founded accusations and numerous reputed witnesses against Sai Baba are ignored without any investigation. Do saffron clothes make an offender untouchable for the law? Do we have to tolerate that political protectionism raises its head so boldly, mocking India's democracy?" I asked in my letter.

Spending a part of the great fortunes, swindled out of the gullible by pretending to have supernatural powers, for social development around his ancestral village doesn't make Sai Baba a great philanthropist. It is a well-known strategy of dacoits and gangsters, to build themselves a strong support base and a safe haven by winning the total loyalty of "their" villagers at home. Hasn't the cocaine mafia in Colombia done the same with their comparatively modest means? By the way, isn’t it a matchless irony that Sai Baba spends money, obtained by claiming the power to cure all illnesses, for super-specialty hospitals? Sai Baba himself, when he recently fell ill, preferred to be treated in one of his modern hospitals instead of relying on his own magic.

The people of India have a basic right to receive drinking water, appropriate medical care, education etc. It is the duty of any government to provide these essential goods. And it is an utter humiliation, if people are forced to receive their dues as alms from the hands of a "philanthropist" who expects them to bow theirs heads in front of him and praise his generosity. The situation becomes worse, if the government leaves the citizens in dependency of a "philanthropist", who is a criminal and a megalomaniac, and claims that he has supernatural powers and even created the universe. Sai Baba's birthday has become a day of national shame for India with a section of leading politicians, scientists and artists at the feet of a charlatan and alleged child abuser. If they express their devotion, because they are personally weak and gullible people, we have to ask ourselves why we don't elect confident, efficient, strong and intelligent politicians instead. If they do so because they want to celebrate the "benevolence" of a politically well-connected fraud and alleged criminal, they are deeply corrupt.
