Attorney Says Heels May Hurt Sobriety Test

DURHAM, N.C. - Attorney Bill Thomas may get a lot more business from female motorists thanks to a novel defense strategy: High heels can help beat a DWI rap.

Thomas last week asked a judge how anyone could pass a field sobriety test — which requires a lot of walking — in a pair of 3 1/2-inch stiletto high heels.

The never-before-heard argument created a minor sensation among court officials and observers.

Thomas contended it would be "fundamentally unfair" to use the results of field sobriety tests against one of his female clients because she was wearing stiletto heels at the time, making her unsteady on her feet.

One of the tests required the woman to walk a straight line for some distance and then pivot quickly. In another, she was supposed to stand on one foot for 30 seconds.

Considering that she was wearing stiletto heels, the woman did remarkably well by making it to 16 seconds, Thomas argued.

Judge Wade Barber squelched the results of the field sobriety tests and tossed out the DWI case. Besides the high heels, Barber concluded that a police officer administered the tests incorrectly.

"These are not lawyer tricks," Thomas said Friday. "I know that DWI is a hot political issue. But the public has to understand one important thing: The constitutional protections that follow us in our daily lives also apply to DWI cases."

Ironically, you can still ride horseback totally sloshed.

Bonnie, I wish I was carpooling with you that day, because I would have mooned that SUV biotch as well and all her little hellions. I'd probably get a ticket for indecent exposure.

I've been driving for more than 10 years and finally joined the club a couple weeks ago. www.ticketassassin.com has great advice/info to fight the man. One thing I never knew (spending more time and energy fighting my ticket than what the actual fine is worth - $110), was that you can submit a form to request the officer's notes prior to your case so you can see what he/she is using against you. It's called "Disclosure". Nolo-Press has a complete book on How To Fight Your Ticket. They have the sample forms. I'm waiting to hear back from the court regarding my trial via written declaration (the better way to go apparently versus gambling the CHP won't show up in court). If I lose, then I can invoke Trial de Novo and get a retrial all because I don't want to go to traffic school and be on probation for 18 months...18 months of going the speed limit...that's like jail in itself. Your description of traffic school sounds great, but there was no mention of playing "Heads-up, 7-up", so I need to avoid it at all costs.

Flipped off some kids.. Well done Bonnie.. Way to craft the young generation. I just usually notify the children there is no Santa.. But I guess flipping them off works just as well.

Then again, if she's that daft that she doesn't care about the safety of a bunch of kids, she shouldn't be too peeved that I flipped them off.

I may have to start driving badly (more so) - traffic school sounds kinda fun!!

Traffic school ? Ha ! Here in canada, we just pay our fines.. No Traffic school needed.. Not like it would do any good.

I seem to always get traffic tickets on first day I'm eligible for traffic school again. I don't know if I have some internal clock counting down to the exact day I can get a ticket again or what. I was able to do online traffic school last time, but I kind of missed the stories told during regular traffic school. Especially the story told by a girl who was pulled over going 105 mph and honestly couldn't understand why the cop pulled her over. She didn't pull over for several miles, as she was sure the cop was after someone else. Lucky for her, he changed her ticket to say she was going 90mph

But what I want to know is... Did you sign up for the lettuce traffic school? Cuz if you did, I want to hear all about this wacky place!
