Clete Weiser wasn't only a letter carrier - he was in management (labor relations - did arbitrations for management) prior to retiring. I do know he went to Washington and testified FOR injured postal workers, so he seems to be back on the 'right' side again. LOL

ELM 438.11 defines local commuting area as: Suburban area immediately surrounding the employee's official duty station and within a radius of 50 miles. Now, I live in a small rural town (15 letter carriers) and we loan PTF's to smaller offices. I interpret the definition of suburban area "AND" within a radius of 50 miles as both critera have to be met to be considered within the local commuting area. So, If a PTF of ours is involuntarily detailed 35 miles away to a town that is "not" a suburb of our town, then its not within the local commuting area and that PTF should be compensated for "travel time" in accordance with ELM 438.133. Am I right, and if so or not, any other references or cases to conform or disprove? I know this is a tough one and will require some work, but I could really use help here as a new shop steward. I have just been seperated from the USPS for a IOD that has lasted over 2 years. Does anyone know where I can go to get help in understanding what I should do now. They (USPS)are sending me all this paper work but know one is telling me how or what I should do next. I did hire an atty. but all he did was eat up my money and tell me nothing. PLEASE HELP ME!!!!!

In response to DOIS "bashing"
DOIS is only a tool. Years ago all of the conversions or measurements were made by pen and paper. Unfortunately this is not a perfect world agreed? Some kind of system has to be used or a handful of bad apples would ruin it for the good ones. In most cases, ideally, DOIS information is based on a regular carriers last count. The biggest thing people have problem with is supervisor_01 telling a carrier that he needs to be on the street at a certain time, and finished with said route at X o'clock. A professional employee, on both sides of the fence, should be able to take this guideline and apply it. The worst thing you could do as a carrier is challenge them to hit the street with you, then not make your time, or get caught in alot of time wasting practices.
The best way to keep your nose clean is to carry professionally, yes this might include undertime periodically, but we should be getting paid for 8 hours of work. City routes are not evaluated. If the mail volume is not there dont be surprised if you are asked to carry an extra split.
