LetterEd:
Did you get my email I sent last week concerning our goals with a class action? I think it came back to me unsent.. I listed some of the issues and the federal codes that are being violated in that email. I do not have time to go back and quote the codes right now, but can do so later if you want. I have too much going on with me right now at work. Not only am I being harrassed, but I was informed that the person that hit me in the back has brought "more grave and serious allegations against me?" Supposebly it happened off the work premesies? I have not clue other than the jerk is trying to keep himself out of trouble as they have made him a 204B. Anyway, back to the issues: Failure to work injured employees " " to process claims per codes "" of the Postal Service to answer OWCP's questions regarding claims. Failure of Owcp to make the Postal Serivce respond or accountable for thier actions. OWCP paying "nurses" to try to get claims dropped instead of "getting us back to work sooner"
I am sure there are many more I am just now trying to find my booklet on sexual harrassement and work place violence that I had the other day? Too much stress and too many things going on with my case right now. I woke up yesterday and could not even move I was in so much pain. But as usual I went to work anyway because I know they will do anything to try and get rid of me. Plus I was supposed to have a "talk with the super to decide what I wanted to do about the guy that hit me" and by the super's opinion on what sexual harrassement is, the guy that hit me and was made 204B is quilty of that also. seems for us injured people, the injury is not enought, it just grows day by day..

I'm glad to see a web site that assists employees through the O.W.C.P. process. I've seen some suggestions relating to the language of a Limited or Modified Duty Job Offer. ANY language which give management the discretion to assign duties should be rejected as "unsuitable". Unless your Postmaster, Manager, or Supevisor is a doctor or nurse, they simply are not medically qualified to determine what duties are "within your restrictions". Challenge any LDJO that gives management such discretion. Secondly, under 5 C.F.R. 353.301(d), any employee "who has partially recovered from a compensable injury and who is able to return to limited duty...at a minimum (should be treated) substantially the same as other handicapped individuals under the Rehabilitation Act of 1973". That means that these employees are entitle to the same protections offerred disabled individuals, and entitled to participate in the interactive process that is reasonable accommodation. Finally, ANY employee, not just veterans, can appeal to the Merit Systems Protection Board if they have an accepted compensable injury, attempt to come back to work in a Limited Status, and the Postal Service will not allow them to work. The majority of employees (and certainly the unions) are generally unaware of this protection for federal employees. Please write to me if you have any questions on these, or other EEO, MSPB, or OWCP matters.

I just read the message that Sandy wrote. He is being harassed because of his injury. I hope that he gets a good lawyer & SUES THE POSTAL SERVICE for all the PAIN & SUFFER- ING that he is being forced to endure while at work. I have written up several managers & when the letters were presented to management, everything ceased, until a new manager would try the same SHIT. wHEN THEY FOUND OUT THAT I filed HARASSMENT & AGE DISCRIMINATION charges against them, they backed off, knowing that the shop steward worked in the area I was working in. This form of HARASSMENT must be stopped & the only way is to write them up as they like to do to the postal worker. We can win if everyone stuck together, but in the office that I work in, very few carriers will work together. I have gone it alone many times & am prepared to continue to do so in the name of JUSTICE. aS THE SAYING GOES, iT'S YOUR WORD AGAINST THEIR'S & BE SURE THAT YOU HAVE THE FACTS.
