The morning Hiddenbrooke was purchased I put a lien on the property, and the Mayor and City Clerk were all notified prior to the purchase; video tape was made of the attendees leaving the closing, all had ample notice of the claim.
While the lien was recently removed by order of the Court, notice of the Motion to do so was not properly served on me. This matter is now under appeal. That appeal is five months from perfection and several more months is allowed for parties to file their answers, then as a matter of law the lien will have to be reinstated because the City Attorney lied on their affidavit of service. It will then 8-12 months from now be returned to the Judge whose decision will then be subject to another year of legal paper exchange, and then another 12 months in the Court of Appeals.
Thats not counting the matter before Judge Pagones, or my claims that are awaiting Pagones ruling on whether I will bring my claims in Dutchess Supreme of Federal Court.
In sum any employee or Council person who includes Hiddenbrooke income as part of the budget while maintaining the current strategy of ignoring my claims, is functionally dishonest and should be removed from office for intentionally being dishonest!
While tangental matters are before Judge Pagones, if Judge Pagones does not allow for the furtherance of the lien VIA entry of my answer on the Gatehouse matter, a new subsequent lien will be placed with the new Federal Complaint as per Judge Sharpe's ruling that the Clean water aspects belong in the Southern District because the Judge did not note any admission of the facts that the State is involved in the Hiddenbrooke matter, which means the matter will be presented in the Southern District so it can be moved again to the Northern District once NYS ASG Cuomo admits NYS involvement, which as a matter of law requires the matter to be in the Northern District as I originally presented it.
In sum given current city conduct on Hiddenbrooke, the City will not have a clear title for you guess, ..... it might be easier to guess how many residents will retire while everyone waits.

get out and VOTE !!!!!!!!!!!! polls open until 9:00pm. PoJo predicts low turnout for local elections. Local elections have more effect on the quality of your life. I will be voting today for the people I believe will do the best for all the tax payers in Beacon. If I have to cross party lines for the best...so be it. We need council people who will stop the waste on pet projects and who will stop the smoke and mirrors on our budget. What happens if the 1.1 million in the proposed budget doesn't materialize (administrator says "they are by no means assured"). Can someone please tell me how much money is in the escrow account for Hiddenbrooke, (we need and deserve the true facts about this, is the money really there, is Preshok bankrupt, if so would that be another law suit to get our money ?) we have spent over hundred thousand in legal fees and still counting with no end in sight (what happens if the city loses the law suit?). How much will the confession of judgment the city wants to sign with Preshok cost (see the agenda for 11/2 council meeting)?? Sorry people I could go on and on... but just wanted to remind people to vote. the 2010 budget is bad, what will 2011 look like ?

I can't believe that folks are rehashing Hiddenbrooke in this election. People need to realize that whether or not the Clara Lou Gould administration should have purchased the property in the first place -- if the city walks away now from the legal action to complete the purchase it will toss away over a million dollars that is due it upon taking possession of title. That million dollars translates into a whole lot of property taxes, so we need this money! Use your heads out there.

/m30799 CV, the best solution is to let the chapel which the city never had clear title to go (never owned!) and negotiate with the grant providers to fund grants for the rest of the property minus the chapel acreage. Seems some on council are just hell bent on getting the chapel no matter what the risk or cost to the taxpayers. Continuing to pump money into legal fees for a hopeless cause is absolutely nuts. It is possible to get the grants without the chapel, it's just the excuse of convenience amongst those who want it to be owned by the city at any cost. Now who needs to use their head?

I think there should be a NO option when voting. If you don't want to vote for any candidates then you could at least cast a NO vote for the candidates that you do not want to see holding office. This will drive home the point that no candidate will carry the majority of the voting public.....

She didn't call him a nazi but said something like a constituent said his artwork on Main St reminded her of Nazi symbols. Her comments were ridiculous and she should have been told to stop talking. She obviously doesn't like George Mansfield.
Sounds like you really have to catch last night's city council meeting. I was there but left after the council members reports. got even crazier after that. sorry I left.
