Help! My brother has had a laryngectomy for stage 4 throat cancer. He received short term disability and in 2004 he enrolled for Long-term disablity with UNUM Provident. Now here is the problem. UP is denying the claim he filed because UP does not have the evidence of insurablily form on file. The boat company he works for knew nothing about giving the employee this form to fill out. Weekly premiums were deducted and sent to UP. The UP rep. said it is my brother's fault for not reading the policy and knowing what is in it. He never received the policy. HR at the boat company said Corporate is looking into the situation. Another question I have. If the LD application was received by UP and it was not complete, or a form was missing, wouldn"t they contact the new applicant? What recourse do we have now? Do we see a lawyer who handles disability claims or what. I would appreciate any input, discussion. Thank you,

I would get copies of all payments sent to UP and like you are doing have his company track down the original paper work. And I know for a fact UP does loose paperwork!! I have submitted that evidence to them. I would see an disability attorney to view my options, he would probably supeana(sorry spelling) the same paper work. Don't let UP intimidate you, and they probably wouldn't check in to missing or unfinished paperwork. I don't see them as being perfect with what I have been through. At times they have been nice and compassionate in the next moment rude and WRONG!!!! When you talk to UP I would let them know that lawyers are always an option. Ask for a complete copy of your claim file and ask that it include all of the documentation that was provided to your employer for signing up for the disability coverage and ask that it only include the information sent to your Employer.
You may find that the form was not provided. If they do send the claimed missing document then you can have your employer to ask for copies of the other employees for the same document to see if any of them have it. It sounds like a "we found a technicality to deny you benefits and you will be unable to meet are requirements on this. You may be able to show it to be fraud by the insurance company.

i dont know what to do, or what my rights are. the problem is that i had my daughter on oct. 4, 2000 and on oct.5 a doctor came to see her. i had maxicare insurance at the time. 3 months after the doctor visit my insurance company went bankrupt. now the doctors office is trying to sew me. what should i do??

i live in lebanon In. it is a doctors office that got a lawyer to sue me.

There is a hugh and I mean hugh class action lawsuit across the county for UNIM Provident denying disbility calims. You should contact one of those laywers. Let me know where you are in the country and I will give you one of them to at least talk to.

Has anybody received anything regarding the class action lawsuit? Unum was ordered to review my case back in March 2004 and I still haven't heard a word from them. Actually, they said by December 2006 they will get to my case. Is anybody getting a settlement offer? What is the deal with this class action?

Unum Provident just denied my claim due to a two year mental nervous condition. My two years has expired but I have a physical problem- chronic fatigue. This problem would allow me to collect one more year of benefits. UP is saying the chronic fatigue is a result of my depression. Do I have any chance of getting the third year? Thanks

Does a Psychiatrist diagnose Chronic Fatigue? I don't think so. Chronic Fatigue is diagnosed by a Medical Doctor and has medical symptoms. Yes, there may be depression, but it is an effect, not the cause. So if a Psychiatrist does not diagnose this condition, how can they say it is mental?

Well I had to fight unum for the same disease, make sure that you list at least three symptoms from the center of chronic disease listed on your paper work!

I fought it myself, I did all my research myself. The internet has a wealth of information. Plus I had kept every letter my doctor ever sent to Unum regarding my condition. I was with out benefits for 3 months. So it can be done. Unum was rude to me.

I received my award letter July 27, 2006 it's already October 8, 2006 and I have not received my backpay or monthly check. I call every other day to see the progress and I always get totally different answers from ssa 1-800 # I'm so tired of waiting I fill they are just jerking me around I call Friday the 6th and they told me that is was at the treasury department. And that they had payed my attorney fees which was 5300.00 dollars but they couldn't tell me how much I was going to receive every month or how much my backpay is. I wish some could help me find out how I can get some answers to these questions about ssa not ssi I have worked all my life until these last few years I got hurt. Thank you for listening and helping me.
