Hey motor mouth, yeah LMOUs can be changed, but its when they can be changed, something you forgot to put in your many words under many names. Article 30 happens when the new contact becomes in effect. So if your the steward you claim to be, the you should know when the Local Negotiations can be opened.

So if the excessing comes before the Local Negotiations are signed off, and the LMOU does not spell out the sections as many across the nation don't, the whole damn tour in that facility maybe screwed.

If the LMOU does have it broken down by sections, then the excessing is by section, not by tour or by senority. May not be fair to the senior people but it will be done in accordance with the Contract of which the LMOU is a part of.

Bluntly put, if by section, then some senior people will be excessed before the junior people and there ain't nothing than can be done to change it unless the LMOU is changed to elminate excessing by section.

But then both Management and the Union will have to agree and both sign off of the LMOU, it not, it goes in to arbitration until settled, until then the old LMOU remains in effect.

..GORT.... Here at the DETNDC we havent worked overtime yet due to the po screw up but were about to get a priority operation on Nov. 14th. Everyone in the standby rooms on t-1 and 2 will be going to work in this operation. The guarantee that this will not be successful is the same reason nothing else implemented by the po has been is the fact it is wrongly being implemented from the start. Managements method of transforming the BMCs cold not have came at a worse time. With the developement of Shared Services and all data coming from there incorrect is nothing but a recipe for disaster. If your facility hasnt kept accurate records of the whos and the whens you are doomed. Guarenteed! Some LMOUs have provisions that state the allowance to open and discuss and identify new mech within a facility in order to amend the LMOU prior to the guidlines of Art.30. Kister has an appointment with Halcisak to discuss residuals in MI Tues. Parties from the Area operations will be present via telephone conference call. There seems to be a discrepancy regarding actual residual bids for the state. While the Local Pres. fight outside we have to fight inside. As members of this local we have yet learned that we the people are the Local not the stewards, bps, Eboard, or the local Pres. I had doubts regarding the things the Union was doing so I took it upon myself to call the National. Everybody is tied up with numerous issues within each and every local and facility its not funny. But why do we,a group of thousands, allow a group of hundreds to do all the work. I can hear it now " well they get paid to do it" and I understand your clamor but if we do not Unite now we will not stand a chance. I know this has been said over and over but I cannot think of a more urgent time. If it were going on here alone or in a couple places we would just say " oh its just there nothing to worry about" But its not just isolated. There is a formed letter collecting signatures addressed to the Postal Regulatory Commision protesting the changes. Write the National and ask your questions and inquire what thier position is regarding the NDC, excessings, abolishments, layoffs, if your concerned about them being paid then make them work for it too. The National seems to respond with the term "sounds like a local issue' which to me is true sometimes but this is not one of those times! you said it. There is so much infighting, management is getting away with breaking the contract. For those of you that face the possibility of getting excessed, watch your steward. Most of them know they are not going anywhere. See how hard they fight to make sure it is done right. NOT!!!!

The problem is like you said Lucas,"There is so much infighting, management is getting away with breaking the contract." Partially true about the infighting but the real truth is that at the Cin NDC the Union (MH) has operated so far away from the contract for so long that noone in power is willing to take the heat and follow the contract themselves,much less require mgmt to adhere to the contract!

What the hell is going on? We are working OT so much. Even when it is not needed. Everybody is on 6 days and at times we are standing around with nothing to do. We only have about 60 MHs and 5 of us had to file a grievance on excessive OT. We don't want any. We won. I say let those that want to work it work it. Amazing how a few months ago we were scuffling to cover assignments when folks were on vacation and no OT at all. Explains why the PO is such a mess,
