Mr. Daniel - Mr. Owens - or anyone - do you know...
1. When you're sent for a secop or referee exam (or any other exam) what is OWCP required to send the physician other than the soaf and their questions? Must they send your entire file - or what? Can they pick and choose which medical information is sent?
For example - can OWCP send just your treating physicians most recent medical documents and any DMA responses and/or previous secop or referee medical - or must they also include any medical you have submitted from other doctors or medical facilities?
2. Is there any particular order in which the file (from number 1 above) is compiled by OWCP when sent by OWCP to a secop or IME?
3. How can I obtain copies of any emails exchanged between OWCP and MCN (the medical scheduling contractor for OWCP)- and any emails exchanged between MCN and the secop or referee that I was sent to?

Ruuth: Yes use the same doctor for the new injury because he has the history and better explain how the new factors caused an aggrc=vation of a preexisting condition.
What correct DX?

Ed Daniel: Post #5315.... None of those DX's are listed in SOAF. They have DX'ed me with them since pretty much the DOI.

Ruuth: You can wait to file the new claim until they have upgraded the old claim. How long will it take to have correct the DX?

When I inquired by phone the CE had told me that she would send me for an IME. At that point 2 sceop's were done. I didnt want to push for the IME. This IME has after a 10 minute no hands on exam exclaimed my injuries have resolved. So then came the job offer.
I had been totally ignorant about the importance of having these DX's in the SOAF. Since these DX's go back to the DOI, and have always been documented, I thought nothing else of it. At this point, would it be less complicated if I had these DX's addressed with the new claim?

Ed:...also..
This IME came about because of the 2 SCEOP's..not my request to include all my DX's.
However the IME did "look" at my EMG and NCV tests and the old MRI's and concluded "radicuopathies have resolved". He is admitting there that they are at least present.

Ruuth: the radicuopathies are not "present", they have "resolved". You may have had radicuopathies, but they are not present as of the referee examination.

Thank you for the responses..I have seen my dr every month since the IME saw me a yr ago. The radicuopathies and CPT have not gone away. And the herniated discs havent gone away. And My dr has written many letters and reports documenting this. He also stated that after being out for so long that its questionable I can return to work. However he thinks I should start with a 4hr day.

Hi Ed I had a total knee replacement year ago and now i need to go back in fo a tendon reattachement could you give me a idea above or below 30,000 as far as monewise for a scheduled award thxs

If a IOD employee is back at work and then is approved for surgery by OWCP, what forms need to be completed? Injury Comp wants CA-2a completed. This doesn't seem right.

Bobby Baker:Schedule awards do not work that way. The award will cover the number of weeks equal to the percentage of a leg according to section 8107 of the Act. A total loss of the leg is 288 weeks. The number of weeks is mulitipled times your weekly pay rate at 2/3 or 3/4.

Snowed:If OWCP has provided written authorization for surgery, OWCP is looking for a CA-7 claiming compensation for lost wages. If your employer wants you to stand on your head for 5 minutes then do so. If they want you to file a CA-2a why not.

To postaljoe: I do not know a lot about the other questions in your case. You can make a Freedom of Information request for those specific emails. The owcp may come back and tell you it may take hours of work and cost $1100 like they did to me. I might be easier for you to ask the second opinion doctor for a copy of your file--hopefully you have not burned that bridge. Even when he wrote a bad report, I was able to do this. If you find there are emails, be sure you get them into your official case file. I do not know a lot about Freedom of Information requests either.
